May i Know under which Sec of BMC /BPMC or Which Law or Act the BMC has to give hearing to the Developer before cancellation of an IOD issued in his favour and before issuing another IOD in favour of newly appointed Developer BY Society by plying a Fraud ?
Can BMC cancel an IOD merely by putting an Endorsement on the same ? if not what is the procedure for cancellation of IOD please give the Sections of Laws applicable with this regard.

sir X sold property to Y...total amount of property to sell is 1500000(fifteen lakhs ) but Y paid advance of 3,25000(three lakh twenty five thousand)in 2005..it is unregistered saledeedagreement..but property was handed over to Y by X..next Y got possesion of property ....next one more thing timeperiod is not mentioned in agreement.i mean contract period is not mentioned....property is commercial shop in hyderabad....later Y did not pay total amount and later X cancelled sale deed agreement by giving through lawyer notice..in 2006...after giving lawyer notice to Y not handing over property..i mean possession of property to X...next Y given property to rent Z ..Y collecting rent from Z...enjoying possession of property....now property is under road widening becaz Hyderabad metro rail project land acquisation to demolish 50% property....next Y and Z are planning to reconstruction of other 50% property....sir...my questions....are....(1) how many years a unregistered sale deed without mentioning time period in agreement is valid...(2)whether X can stop construction of shop remaining 50% by getting injunction order or stay matter..becaz Y and Z are trying to construction shop.(remaining left after road widening)....(3)next how to get property possession from Y to X....(4)since from 2005 Y enjoying giving property to rent ..taking rent..if X asks abut rent ....Y says property is in my possession i can give rent to anyone...is there any way to seize property.. or deposit rent to rent controller or in court....(5) whether LIMITATION ACT IS APPLICALE FOR UNREGISTERED SALE AGREEMENT WITH OUT TIME PERIOD MENTIONED......

During an argument session, if a lawyer miss out on some point/ or if defendant remembers an important point which was not discussed earlier with the lawyer; can the defendant plea to talk about that point in the court by taking permission of judge?

Sir,
Under impression, "A" (wife) had been mentioned in service book by husband "B".
later his wife deserted him and he performed second marriage with "C".
After the retirement his first wife "A" filed maintenance case, which was rejected by court, finding that she was illegal wife because she married with "B" when her husband was alive.
After the death of "B" Asam rifles started to disburse family pension to "A".
His second but Legal wife "C" requested to Asam Rifles to cancel the name of "A" from service book, and to enter his name and to allot family pension to her. She has sent judgment of 125 in which "A" has been declared illegal wife.
But Asam Rifles is refusing to do so and says as name of "A" is entered in "B"'s service book as wife it is not possible.
I have filed civil suit for the declaration and mandatory injunction. To declare "C" as legal wife of "B" and to direct Asam Rifles to enroll her name in service book and sanction family pension to her.
Sir as I am novice in service matters, pension etc. Please help with relevant pension rules and case law if any ?

My quarry is that if police deliberately ignour court s order for implementation of restraining order and police instead restraining other party threated us not to interfere in construction and allow construction work .
Now my question is that the contemp t proceeding against police can be iniciated before the district / high court direct when order of implementation through police passed by Munsiff.
If any case citation please

Dear sir,
I am writing this letter on behalf of my younger brother as my family is facing alot of trouble and having less knowledge about law we are finding it very difficult to cope up with situations.
Sir my brother fell in love with a girl in college and rand ran away from home and married with the girl in court. The girls father lodged an FIR against him for kidnapping their married daughter later when asked the girl told to my brother that she hided this secret as she dnt liked her previous husband whome she was married earlier in native as our family did not accepted this marriage we have not allowed them to enter our home and avoided any contact with them so my brother nd that girl started staying elsewhere but as per my brother the girl has actully fooled him as she wanted complete freedom after seeing her modern lifestyle, unruly conduct, torture my brother left her and started living sepratly so her family members have taken her into their home and now they are torturing us by sending lawyers (who know everything except law) that our family has planned all this and they want urgent marriage openly. We have told them that we are not in contact then they are threatning us that they will forcely enter the girl in our home irrispective of my brothers presence when we contacted our brother he is saying that he dnt want to be with her and wants to give her divorce on the grounds that she is already married and have not told me about this . Sir they are thretning us that to destroy us i am yet unmarried so how we will accept her. Please suggest any legal remedy will be very greatful to u.
