Bankrupt

Hi,

I have taken friendly loans from several friends to trade in Forex Market is about 50 Lac Rupees and issued them some emptry Pro Notes and some Blank Cheques, with interest of 10% per month, I paid regular interest for few months...but all of sudden I have lost all capital bit by bit in Forex Trading... and I m not able to pay the lent money now..

I have a small house which costs around 25 Lac Ruppes and It has a Bank Loan of 10 Lacs on it still, My lenders want me to sell that house and settle them some amount and rest should be paid afterwards, but If I sell that house and I am jobless now I can not regain that much of amount in Forex Market so easy, it needs around 4 - 5 years for me to recover the loss with small investment of 1 Lac or so,

I am completely helpless, what shall I do? I did not issue them any receipts or Bonds, can they file Criminal Cases like 420 etc... on me?? what If I file Insolvency in the Local Court? Can I save my House?? I can try to pay the bank loan of house, and I can pay my lenders also if they give me time of atleast 3 years...so, please advise me how to proceed...
Regards

B.t. a. a. l.

Weather A.L.T. has right to entertain application under O. 1 R. 10 of cpc in 32g proceeding?

Fact of the case are:
1. Mr.M1 and Mr. M2 are owner of suit land.
The tenant have made application u/s 32g before A.L.T. to determine value of suit property and show their willingness to purchase the land.

2. The owner of the said land have not appear before the h'ble tribunal.

3. However a third person have appear before tribunal by making application under O. 1 R. 10 of C.P.C., stating that his mother is owner of suit land and Mr. M1 and Mr. M2 are just appointed as MANAGER for the said land. (mutation entry is there on 7/12 stating "owner is widow hence tillers day is postponed"

1.now the question is whether tribunal has right to entertain such application(O.1 R. 10 of C.P.C.) at this stage?
2.whether at this stage can tribunal add such person as party to case?
3. widow has expire on around 1986 but no changes have been made to 7/12 to that effect. can limitation be ground to dismiss the application?
please advice

Property problem

Respected Sir
I am Ravichandran native of opilliappan koil, Kumbakonam. We are 7 members in our family. In 1998 my mother passed away . My father and us with village panchayat people wrote a pagakaraiolai pathram on white paper. My fathers house(Father self acquired) is the common property . In the pagakaraiolai they wrote that I shall acquire the full house and in turn I should settle 6Lakhs cash and 6 plots each size 2400Sq ft from my land which is self acquired property. The agreement was not registered. My father, two brothers myself and 6 panchayat people signed have signed it. The youngest brother didnt sign it and he demanded more from me.My father passed away in 2003. After that the brother who didnt sign has occupied that house. He disturbed my property and in 2004 I have got permanent injunction order from the court against him.
This year in march 28 , 2013 we 4 brothers 3 sisters made a second agreement in light green paper with the help of panchayat people. In that I will acquire the house and in turn I am asked to give more than what was written by my father and the settlement should be made within 30 days.We have not registerd the second document .. Now another brother and the youngest one are demanding more from me but rest of them agree as written. All the 7 members of my family and 6 witnesses have signed the second document
I am living in U.A.E and I have given power of attorney to my father in law for my properties
My questions
1. Shall I move to the court with the agreement written by my father? as my uncle says that it is like "will document" of my father even though the younger brother and sisters have not signed it as it is my fathers self acquired property
2. or shall I file partition case for 1/7 of my fathers house
3 The 2nd agreement expired on april 30 2013. Is it valid any more?

Kindly reply me sir
.
Thanking you
