Residential property

Dear Sirs,

Tenant is currently living in a house for more than 50+ years and rent was paid in beginning somewhere in 1947 for 3-4 years (Rent receipt in place). Afterwards there was change in ownership (Not sure who claims to be landlord whether actually is or not) which was not communicated to tenant and continuing living without any interruption by landlord. As per Limitation law a landlord cannot file suit to recover the possession after 12 years from the date tenancy is determined. I want to know what re course is available to tenant? Whether continuing living so long will give any claim in title of this property? How can proceed further? bcz present landlord is not agree to give enough money to change the house? Experts are requested to kindly guide. Thank you in advance.

time period for clearance of objection by plaintiff

1.P filed one Memorandum of Plaint for partition in May,2013. Court raised certain objections which he has not yet cleared despite lapse of 11 months. Is there any limitation for the clearance of objections. If he does not clear objections, whether the suit shall be live for ever.

2. P, in the above case, claims that the property is under litigation. Can he claim so for ever.

3. The claimed property has been alienated by his father long back. Now, he has painted the outside wall of property starting that thep property is under litigation. Can an FIR be filed against him. If so, for which offences and under which sections.

Educational trust (amended deed)

Dear Sir / Madam,

We had registered a Trust Deed on 2000 with 20 members, due to some reasons 15 trustees (some of the trustees are died & they had added their legal heirs) joined together & made a new amended trust deed, in the local registration office.

The following are the findings, which we later found in the registered amended trust deed:

1. One of the Trustee was died on 2007, but in the new amended deed, it was written as he is still alive & due to his illness, his legal heir has become the member of the Trust (The died person, haven't written any will / document for appointing his son as a trustee)

2. Is this a criminal / civil offence, for stating a false statement in the recently registered trust deed? Please let me know the civil sections & what kind of punishment would be given under the law?

3. We are the remaining 5 Trustees, shall we file criminal / civil case against 15 trustees who had signed the amended deed?

4. Under section of law, they can be charged & what will be the punishments for doing these unlawful act?

5. Does the amended deed document will be valid, for taking possession of the trust?

6. What will be the minimum & maximum punishments, for these wrong doings?

Thanks in advance.
