Advocates act and bar council of india rules

Bar Council of India passed certain resolution restricting the appearance of certain advocates in a particular type of courts. A Gazette notification was also issued in this regard. The resolution and the notification came to be challenged before a High Court and the High Court stayed the resolution and the notification.
Some other advocates also challenged the same resolution and the notification before another High Court
My Query is-
1. Whether stay order passed in respect of the resolution and the notification is binding on other high courts also and they should follow it.

2- Whether enforcement of said resolution and the notification by any of the State Bar Council despite of stay amounts of Contempt of Court. If yes which High Court will have the jurisdiction for cognizance and what will be the procedure.

3. Whether there is any Judicial pronouncement/authority for this.

Interim temporary Injunction order

Dear all, my father is owner of a shop which he bought in 2007 when earlier tenant's son was running the shop. Now both earlier tenant and his one of the sons expired but the widow of his younger son is now keeping the key of the shop, when we tried peaceful possession by going to.collector of the state, who gave an order to take possession of shop.with police protection but due to corrupt police officer, he informed the tenant's son's wife who put wrong civil suit on.my father and police
Made the collector order void. Now recently court approve temporary injunction order on plaintiff name and hence my lawyer is asking to go for appeal but he charges very high. The court accepted the tenancy right of son's wife who is not doing any business in shop also balance of convenience is.assumed.in.her favour and hence the interim.order has passed to keep as.it is till the case is disposed off. I am worried she is trying to give this shop to other person for running and not sure what to do, if I don't go for appeal may be my case become faster but and can get quick resolution. What is your opinion and experience? The court is Tallulah court of Gujarat. Regards. Rashesh shah

Stamp duty on partnership retirement

One of a partner retired from the registered partnership firm by receiving his goodwill amount and moving asset mentioned value of rs8470000 by retirement agreement of 100 rupees stamp paper in tamilnadu.The agreement was recorded in firm of registrar.Now some of registration official say that if the retirement agreement is audited 3 percent plus fine will be imposed on that otherwise it may not be evidenced in court.please advise

Hindu succession act 2005 cut off on Women's right

We are 3 Brothers and 2 Sisters. 1.80 acres of Ancestral property of My father shared by 3 Brothers in 1994.we did Partition orally. we paid Land tax on 3 Brothers Name from 1994.we have Land tax receipts as proof only.we dont have registered Partition deed ,because we partitioned orally.we have not mutated our 3 names in revenue Record.our father died in 1987.
Without our knowledge , our Elder Sister silently mutated 1.80 acres Land into our mother Name in 2017. After Mutation into our mother Name, My mother executed a Gift deed of 0.54 acre in favour of our elder sister. Today we came to know about this cheating. Immediately we asked our elder sister to cancel the Gift deed. But she refusing our proposal. More over she is saying "she has a Share in 1.80 acre. She will not cancel Gift deed."
We consulted few People for justice in our village.
They said legal Points as Per Hindu succession act 2005,

1.women could not ask for a share if the property had been alienated or partitioned before December 20, 2004.

2.Daughters cannot inherit ancestral property if father died before 2005.

With this points can we Go to Court and cancel Gift deed?

Police verification

Hi sir,
I did have credit card with sbi cards unfortunately I was unable to make to payment for its dues because I lost my job as well as I lost my father on that time period. But as of now I already made settlement with the bank and made the payments on his term and condition. My main question, I got selected for up police as SI. Does credit card default or settlement effect my police verification? One more thing I would like to clear that I did not receive any call and legal notice from bank between the time period and I confirmed with the bank about civil suit but they informed me that this information is not updated in his system. So what should I do in this situation my police verification is about to come. Please help.

Public alcohol consumption

me and my friends were caught with alcohol in our bag from a public place.i was 18yr old and my frnds were 17.they took case on me for public consumption of alcohol. how and when will the samence reaches my house and what do i have to do when i get it.and iam going to apply for passport. do i get passport because of this case.

Civil miscellaneous case

I am from Allahabad. Here I live on first floor and there is another family living on ground floor. The lady of the ground floor file a civil case against me in 2013 and asking for partition. In 2016, she again filed a case of contempt of court of 2013 case and in 2017 she filed a miscellaneous case with the same 2013 case number. So please let me know that the lady has filed only one civil case against me or she has filed three different civil cases against me?

Civil matter

I am looking for a guidance in this forum. I have a land in 1969 and consrtucted a building on that land in 1972. From 1972 I am staying with my family in this building.To give a background of the land that I purchased the land belongs to two brother. In 1949 one brother constructed and the other brother sold his portion of land to different parties. I am one of them who purchased land from the person who has the right of the property. After purchasing the land which was buted and bounded in my deed I apply for a sanction from corporation and after sanctioned I constructed my house.
In 1989 my neighbour who constructed his house in 1949 sold his property to another person (Mr.X). In 1992 Mr.X filled a suit against us claiming that we have encroached his property and we have constructed on his property. From 1992 till 2010 we fight for our property and we lost a portion of ou property. The commisioner who was appointed to do comissioning got purchased by Mr.X including my lawyer. Finally the judgement went against us and the execution was happened. In 2010 Mr.X taken the possiton of the property by court’s order. In 2017 we identify that the possesion that was taken by Mr.X was entiterly fraud. We have collected all the documents where he identify that Mr.X purchased the land don’t have any proper scedule and also no property demarkation of starting and ending point. Now we want to file a suit to recover my land which was wrongly taken. He has taken more than what he actually owns After discussion with my civil lawyer, my lawyer is saying that we can’t reopen the case as the court will say once the order was executed satisfactorily we cann’t file the suit against the same land which was already closed. I need an advice whether is there any way out to get back my land which was taken fraudly. Thanks in advance for all your help.
