Is invitation to tender containing terms and conditions is an agreement enforceable by the law, where a subsequent agreement is required to be signed. can a party after submitting a tender back out from signing the subsequent agreement. if yes what liability incurs upon such party.
This is a business transaction between two companies.
Against an offer from "A" for supplying certain item, "B" a company agrees to supply that item on a certain price to which 'A' agrees, "B" the supplier company do not wish to supply that item or unable to supply, what remedy "A" will have against "B". Does "B" has any right to rescind such agreement? What liability "B" will have?

A central ministry, appointed Mr X as addl director in a PSU board in NOV 2010 for 3 yrs. Appointment was to be confirmed in next AGM in Sept 11.Mr X however resigned on personal grounds just before start of AGM and accordingly ceased to be director from date of AGM. 8 days later he wrote to ministry seeking withdrawl of his resignation and continuation as director .Ministry agreed & directed company accordingly.
In my opinion ,his reappointment byepasses the AGM & is only a back door entry to the board and is not legal. Will some of the experts comment ?

Form h not given by customer
Hello,
I have sale against Form H on 25.07.2012 for amount Rs 14112.00, customer has paid all amount via cheque but not have provide me form H, for which I have sent so many reminder emails and even called him so many times but he always excuse by saying " It would take one week time to furnish the requirement. Please bear with us."
Now I am irritated with his response even one time when I said, I will complaint against you then he replied; the language what you are using is not ethical business language. you are threatening us, You are working with a reputed company and not with some sort of supplier. If you are not aware of us than I would request you to please come and visit our factory and then you'll realise that the language you are using is not at all practical.
----------
It has been so long but still he has not submitted form H. I would like to know what action I will take against his negligence.
Thanks
