Dear All,
In our case one Mr.X from Korea( Foreign Resident)wishes to establish a company in India,main activity of the company is Retail trading of Garments and clothes, textiles.
Please explain whether the above activity is covered under automatic route as per FDI policy or will require FIPB approval.
Please also define what is wholesale/cash & carry trading ?

On applying for converstion from a public company to a private company,cofirmation of substantial creditors is required.What is the meanibg of substantial creditors ?
On conversion,can a private company continue to have a public company as its subsidiary ?

The Press release of RBI Dated 08.04.1998 requires two test based on Financial Assets .
What is Financial Assets for this Guideline.
Should I Follow Definition of AS -26 or Shall the Definition of S.45-IC shall be Followed ?

My current account has been marked as ON HOLD for a fund of Rs.2,89,000/- by HDFC BANK.I am sole proprietor of the company which holds current account with bank.The bnk claims thay I have not fully paid the loan taken for the purchase of car in 2002 with last installment due in october 2004.
The said loan of Rs.2 Lakh was directly disbursed to Car Dealer however I was asked to sign blank agrrement and 24 PDCs were issued to them from me.
The Car dealer lost his dealership and also liquidated his company and vanished without giving me delivery of car.
The Hon Consumer Forum of Mumbai-Bandra has made an order in year Nov 2008 asking me to recover the money from dealer.However I find it difficult to locate the person and company on my own.
I had paid 9 out of 24 installments to bank .Bank also adjusted some amount lying with them on dealer's account against the said loan.Consumer court has clearly said that the dealer has misused the loan.
Bank never made any communiction or filed any suit against me till date.
Surprisingly after almost after 7 years they are holding the current account money meant purely for business purpose of my company. I opened this account in year 2007 and it was not in operation when when the said loan was disbursed.
The bank sent me notice on 31st and the cheques were deposited by me in bnk to a tune of RS.4 lakkh on 29 nd 30 DEC.It clearly shows that they were tracking the account and wanted to hold the fund first and then send notice to me.
I have sent them an iterim reply asking for inspection of loan and current account documents to make a final reply however the funda are still ON HOLD and no reply from bank yet.
I need to know that for how long bank can hold funds without replying?
Is bank correct in using Lien Act without filing any civil case for recovery?
Is it allowed to hold the funds in Current account which was not even in existance at the time of a loan agrreement or has got no connection with personal car loan account?
Can bank hold any amount of money that it claims as a due amount without any acceptnce from me?
Is there any procedure or guideline from RBI to use this act and has bank followed it in my case?
Which are the immediate legal actions i should take agaianst Bank?
And most importantly what happens to the cheques which were returned due to this act of bank?Am I guilty for dishonoured cheques issued before the notice date?

Hello all the experts,
My que is regarding the full and final settlment with company once you get resign.
I have resigned from my previous organisation,they have signed the full and final doc,gave me relieving letter,experience letter too but not yet got my full and final amount.
when did enquired about it with HR,they told that my boss has asked to keep it on hold as data handover is not done properly.
What I can do under such circumstances.
My boss is doing it purposely to trouble me.Can I send official notice to the organisation as I have full n final doc+relieving letter+experience letter too.

Dear Experts,
I work for a leading KPO (in Bangalore) and till date we have been hiring freshers and we were training them for 2 months (we do pay salary during this time). Off late, the demand for our skill based training has become high, and we wish to start our own training academy, where we like to invite participants to join our training at a reasonable cost and based on successful completion of this training, we hire them. The questions are, 1) Shall we register a training academy in a different name, however run this academy in our own existing premises? 2) Our company comes under STPI regulations (bonded warehouse), 3) If our employees are going to train them (like trainers) do they have to be employed under that academy?

Hi All,
I worked for a company for more than 2 years in Noida. I left the organization in 2009 but still my full and final settlement is pending with them whenever i ask for this they make excuse of fund shortage?
Can i take any legal action against them in Consumer Court? if yes then please provide with the procedure also..

Dear All,
Pl. clarify my doubt on this issue.
I have LIC policies, in which my wife is nominee. The surname of my wife is not legally changed to first letter of my name. Unknowingly I used first letter of my name to her as surname while taking the policies. My wife has all ID proofs with her father name as surname. Will this mismatch in surname between ID proofs & LIC policy give a chance of making issue while claiming the settlement once the policy is matured?
