service tax

The recent ammendment of the service tax rules has introduced tax on the restaurants having airconditions providing food alongwith alcoholic beverages subject for tax @3.3% on bill value w.e.f 10.05.2011.
my question is that, wheather a restaurant having separate rooms serving food at the one part and food alongwith alcoholic beverages at another part be liable to pay above tax on both the bills drawn?

I aunty have her own family (Son& Husband). But she wants to transfer her proprietor ship business to my name .I want to know what are the formalities she has to follow to do the same?

Partnership Deed

Respected Experts
If a Partnership deed of a running partnership business is lost & no copy of such deed exist then what to do - does the Partnership business is automatically desolve - again that deed was registered through Notary Public, but not registered under partnership act then can such notary help us in this regard or not

Hello,

I am a resident of Maharashtra State.

I want to start a Website / Software Development Company, which is NOT a Pvt. Ltd. but only carries a Name, for EX: ABC Technologies.

1. Is it possible or not ?
2. If it is possible, then in which Government Department I have to Register ?
3. What are the Documents Required to be furnished for Registration ?
4. Which Certificate / License is required to run the Company ?
5. Will it be Service Firm or Proprietary Firm ?
6. The Owner can be a Director or Proprietor?
7. Can I get the Service Tax / MVAT Registration Nos. ?
8. In future, can I convert this Firm into a Pvt. Ltd. Company ?

Mispacement of cheque by banker

I deposited a Rs 3 lakhs cheque with Vijaya bank, the said cheque was dishonoured.Bank deducted service charges from my S.B.A/c, but misplaced the cheque due to their negligence.I could not get the amount from the client.Later, Bank got another cheque from the said person, but it was misspelt, post dated and without a/c no and of another bank.

I complaint to ombudsman, but,he passed order without any hearing, then I approached Dist consumer Court, which passed an order in my favor for cheque amount with int @ 5% p.a.now Bank had appealed to State Consumer forum and got the stay.alredy 7-8 yaers passed.I am in urgent need of money for medical treatment of my handicappped son,
Pls guide me the way for early recovery of money from bank.

A question on Transit Insurance

If the buyer s to go for transit insurance as well as fix a transporter to bring the material to the buyer's premises which is in a different State what are the criteria the buyer is to look into for transit insurance.

Goods Detained by the transporter


A Ltd deducted Rs. 3.5 lacs from B Ltd, atranporter on account of goods lost in transit(diff of actual claim and amount recd. from the insurers). The deduction was agreed and accepted by B Ltd in writing.

The business afterward continued betwen the two compnaies. After almost 6 months, A Ltd handedover three consignments of diff. location to B ltd for delivery. B Ltd detained two consignments and sent a letter demanding intt. of Rs. 5 lacs on delayed payments of earlier period and release of Rs. 3.5 lacs deducted on account of insurance, thogh B Ltd has alreday accepted in wrtiting. But now B Ltd says that the letter was given by them under pressure to get the overdue payment released from A Ltd. The material has been detained by B Ltd for more than 4 months.

A Ltd makes up mind to lodge an FIR u/s 407 IPC.

Can anysone suggest the merits and demrits of A Ltd in the present case.

B Ltd on the back of its L.R. printed certainan terms & conditions of their tranport contract, which inet alia includes that they are entitled to lien on the goods to recover the outstanding payments/dues. Does this clause legally entitle B Ltd to detain the goods.
