there was a recent judgement by the Hon'ble SC that "it would amount to contempt of court if the insurance Co.argues that the driver of the vehicle was not carrying an effective license without substantiating it" i had read this a month ago from SCW but forgot to mask the citation and presently need the same for the moot court competition... looking forward to ur help thank you.

my questions are:
1)is the director or board of directors capable of deciding WHEN & HOW to distribute the dividends,for that matter whether to distribute them or not?
2)difference between salary and remuneration?
3) if a person is director in TWO OR MORE companies,can he/she derive SALARY from both of them or salary from one of them but remuneration from both of them?

Notification issued for the recruitement in state government department. the notification mentioning all the procedure of the process/ pattern of exam, number of questions to be asked,negative marking criteria,topics to be covered/syllabus, as per the relevant recruitement rule book. but they hav'nt mentioned the minimum qualifying marks i.e 40 in the notification. while according to departmental rule book min.qualifying marks was 40 .the result was declared and majority of students , 39 out of 41 selected candidates scored less than 40 marks as the paper was too hard. though they were declared successful. so plz tell me whether board conducting the exam can omit this criteria from the rule book.i.e.minimum qualifying marks.as it was no where mentioned in the notification that a candidate getting less than 40 will be disqualified despite being mentioned in the relevant recruitement rules .plz reply thanx

1.How many persons are required (Minimum) to create a Charitable Trust ?
2. How many persons can act as trustees of a (Maximum) Charitable Trust ?
3.How many persons (Minimum & Maximum) are required to creat a Association of persons like Flat Owner's Association, Club Member's Association?

Selection Moot Problem
Alpa was a young aspiring model of 19 years .She had made a steady progress in the modeling field and had a short term contract with some of the well known brands. As part of the requirement of the profession , she had joined a gymnasium . She worked very hard at the 'Model' gym to maintain fitness.
On the fateful day , she was working out on the treadmill , trying to test her stamina . She put treadmill at 10 km/hr speed and kept the inclination at 40 degree . That is an extreme test of stamina which the management of the gym had specifically prohibited .
At the time of joining the gym , no rules and regulation were communicated to her except to carry shoes in bag instead of wear and come (to maintain cleanliness) and towel to wipe sweat . However on every
Trade mill, there were written instructions not to exeed the speed of 8km/hr and maximum inclination o f 20 deg. The instructors at the gym could not insist on the rules as they were held up other regular exercise which reqiure 1 to 1 instructions
While Alpha was trying to test her stamina, she started feeling exhausted and she was losing strength very fast. To cope up with the test she was concentrating on her legs and trying to encourage herself.
At this stage, electricity went off and treademill stopped abruptly. This, she did not realise immediately and took another another long step and fell on the front portion of the treadmill, injuring her face and arm.
When she was taken to the hospital by her colleagues and management, she had suffered a broken jaw, torn lips which require three stitches and disfigurement of the lower jaw. Her right hand was also fractured.
As a consequence, she was not considered by two of the major brands who were coming up with a nationwide advertising campaign, as she rquired at least six months to recover. Two of her existing contracts were also terminated.
She therefore has filled a case against the ‘Model’ gym to the compensation.
pls help me with legal facts for the above

Respected lawyers,
i want to know that can university makes any changes of the student record from tabulating register?.My problem is that i have passed my graduation exam from my university in UP in 2008,but university staff members are telling that your record does not present in the tabulating register.I am sure they are telling lie,don't know the reason.I want to know that does student university record present anywhere else like to the state government so that i can prove my truth.
Name errors
My 9th standard teachers when filling out my cbse registration copied out the details given in the passport. the name was given in the order {surname,given name}as the feilds for the above was given in that order in the passport and they thought the name was in that order. hence when the teachers filled out the 11th standard registration they had to use the same name. the problem arises when i have to apply for foreign universities where they specifically asks for given name, middle initial and last name.
My name on the cbse registration is ne**** mu**** nithin where nithin is my given name in the passport and for the college application nithin n mu****. is there any way i can change the name to match the college application. i am currently in 12th standard.
