Dear Sir,
As per Clause VI (a) of Creamy layer criteria “Persons having gross annual income of Rs. 4.50 lakh or above (The Income limit has since been raised from Rs. 1 lakh to Rs.2.5 lakhs w.e.f. 09.03.2004 vide DOP2T O.M, No. 36033/3/2004-ESTT(Res) dated 09.03.2004 and subsiquently raised to 4.5 Lacs vide DOPT O.M Dated 14.10.2008.) for a period of three consecutive years or possessing wealth above the exemption limit as prescribed in the Wealth Act for a period of three consecutive years will be treated as creamy layer.
According to my interpretation is,
Here the word “for a period of three consecutive years” is important means that from last 3 financial years if the income of any one financial year is less then Rs. 4.50 lakh (The Income limit has since been raised from Rs. 1 lakh to Rs.2.5 lakhs w.e.f. 09.03.2004 vide DOP2T O.M, No. 36033/3/2004-ESTT(Res) dated 09.03.2004 and subsiquently raised to 4.5 Lacs vide DOPT O.M Dated 14.10.2008.) will not come under creamy layer and get the reservation.

2007-2008 2,00,000.00 Rs.
2008-2009 4,60,000.00 Rs.
2009-2010 5,60,000.00 Rs.
Q.1. As per my interpretation a person with annual income ( business
income” )as per above mentioned years for three consecutive years does not come under creamy layer as his income for one of the three consecutive year is less than Rs. 4.5lakh/annum.
Is my interpretation right or wrong ?
Please give me quick reply as my son would be having his counseling for admission into engineering college this July 2010.

If I start a periodical and sell it at some profit. And if the profit is completely utilized for charity work and further printing expenses 'll the money be taxed? The periodical is aimed at helping the students with their curriculum and also no assets 'll be bought or any salary obtained through this profit. Just like a social work

maine mulund railway station ke paas ke post office se 07/05/2010 ko 2 letter bheje thaa. jisme se ek letter ka pata nahi chala dusara letter mere ghar par wapas aa gaya us letter par kisi tarah ka post mere area ke post office ka stamp nahi thaa kyoki main thane mein rehata hoon aur maine mulund se bheja thaa. jab maine post office main enquiry ki toh kehate hai ki galti se tumhare paas wapas chala gaya. maine yeh letter job ke application ke liye bheja thaa.mera paas bheja hua letter ka detail hai. so please suggest me any legal idea.

For eg.if an organisation releases a periodical.The printing cost of a paper be Rs.4. If the selling price be 6 or 7 rupees.. Should all the profit earned be diverted towards charity for tax exemption? Or can any part of it be used for further printing expenses? 'll that result in taxation? Also there won't be any salary or assets purchased by the members of the organisation with this money..
Does a periodical that is meant only for school circulation require registration with the RNI??
