Divisional Bench gave this judgement in a special appeal filed for the recruitment of physiotherapists in uttarakhand.
We, accordingly, allow the appeal and modify the
judgment and order under appeal by upholding the quashing of
concerned merit list of Physiotherapists prepared by the Board, but at
the same time, direct the Board to reject all those examinees, who
appeared in the examination for being appointed as Physiotherapists,
but not received 30% marks in diploma examination and to complete
the selection of Physiotherapists by adding to the marks obtained by
the fit examinees in the written examination, 30% marks for
intermediate examination and 70% marks for diploma / degree
examination. Let the said exercise be completed as quickly as
possible, but not later than two months from the date of service of a
copy of this order upon the Board.

Hi, I am Sumit Kumar, pursuing B.Tech [2007-2011] from Maharishi Dayanand University, Rohtak. I have not yet completed my course due to continuous prevention from university's side to pass students. In Aug 2012, I got my result in which I scored 17/100 in Java which I completely didn't expect. So, I filed an RTI on dated Aug 13th, 2012 against my answer book which I saw on dated Sep 12, 2012 & was shocked to see the checking criteria by the university. The only thing marked with red pen were my marks. Not even tick marks on the paper. Also, for an answer for 2 pages, I got 2 marks & for an answer of 6 pages, I got 6 marks & for some I got 00. They only saw the start & end page of a answer & that too gave a horrible marks without even reading them. This clearly indicates that university is neglecting the checking system so that students pay money for re-appear & re-evaluation.
Also, I suspect that my answer sheet was checked AFTER I filed RTI, & put marks which would constitute to a total of 17/100 which was reflected online on my result.
This time university has failed 90% of the students from my college, most of which scored 17/100.
So, I am planning to file a lawsuit against the university for such obnoxious behavior against students. Please help me in doing so.
I also approached my College but they said that we are not responsible in any of this because the rule of university is that I can only get my answer sheet re-evaluated if I have at least 20% marks which I don't have. They also said that only court can make them change their rule, college can do nothing to help.

hi, the obiter dicta of any judgement are not binding on other courts, but is their any example where a judge has based his decision on the obiter dicta of a previous case? examples from indo-pak judiary will be of great help to me,

sir mai pg kar rha tha jise break kardia tha or job mai agaya pg mai stipend bhi milta tha bond bhi bhra tha mujhe chutti nahi mil saki 3 saal se phle job se islie join nahi kar saka par university k rule k hisab se 6 saal ma complete kar sakta hu or join na karne ki wja se audit ki wja se recovery letter mere department aae recovery k par mujhe dubara join karna tha islie delay karta rha. ab leave milgai hai or applicatin pg ki underprocess hai time lag rha hai. par department wale recovery karna chahte hai mai kuch din k lie recovery par stay chahta hu bger kisi par case hue k kuch time mil jae mujhe agr admission nhi hua to mai recovery ko tayyar hu.
