Domestic violence

Respected Experts,

My query is regarding domestic violence act.

As per batra's judgement daughter-in-law cannot reside in in-laws house without their wish.

But if the house was in the name of father. He died intestate. The property is now in the name of mother.

My query is if the father died intestate then the property will be inherited by the members of the family as per hindu succession act wherein all sons, daughters and wife will have equal share in the property.

Thus if the son is having right in the property then can it be called as joint family property and in such property can a daughter in law claim for residence order.

Thanks & Regards,
Suchitra

Legal heir certificate validity

I acquired an apartment 3 years ago which is our primary family residence. As my wife was much younger than I am, I registered the property in both our names. We have one daughter, presently 8 years old. The property was hypothecated to a bank as I had taken a loan to buy it. All payments for the property were made by me individually from my personal account. My wife passed away 3 months ago. 2 months ago, I cleared the loan on the property and received the no-dues certificate as well as the original documents from the bank. I have obtained the legal heir certificate from the Tehsildar concerned. It shows that my daughter and I are the heirs.
Question 1: what is procedure to make my minor daughter joint-owner of the property?
Question 2: If I wish to again hypothecate the property as security to a bank, will the Tehsildar's legal heir certificate be sufficient so I alone can sign the hypothecation, or does the property first have to be transferred to my minor daughter and I, prior to the hypothecation?

Office policy

work in an advertising agency, an industry that rums well beyond the typical 8hrs everyday.
Our office timings are 9.30am - 5.30pm
One hour grace period is given, post which a late mark is put if one enters after 10.30, and a half day leave is deducted beyond 11am. Beyond 2pm results in a full day leave.

If I enter on time and work till 9.30pm, there is no compensation given. I can enter 1.5hrs late post. Eg, if work till 10pm, I can enter at 11.30am.

Basis this, the company has cut multiple leaves. For there are days when we work at a stretch for 15hrs. And some when you work for less than 8.

Possibility is that if you're working for 15hrs one day, you have to come early the next to finish it off. So the late coming becomes useless.

I want to know if there is any legal action I can take against the company for citing my leaves even though I've taken only 2 (medical + casual) in the entire year.

As the leaves I'm fighting for can be cashed out later, I end up losing almost a month's salary basis the current policy.
