Associate membership of tenant co-partnership society

Dear Expert,

In May 2008, The husband of the member (who does not hold share in the property) applied for associate membership with duly filled form. But the relevant fees was not paid at that time. The Managing committee (MC) had passed the resolution in June 2008 approving the application in which the proposer of the resolution was absent as the signature is missing in the attendance record of the same MC meeting held.

Now the member has tendered the associate membership fees in Feb 2016 and asking the MC to accept the fees to regularise the membership.

The AGBM had adopted the New model byelaws of 2014 in Sept 2015 and sent the same to registrar for approval in Nov 2015. The previous registered bye law is of 2002.

Please help on knowing what steps should the MC take in this matter.

DRT/cgtmse case

I had a partnership firm in New Delhi, and me and my partner took a loan of Rs. 70,00,000 from a bank under the CGTMSE scheme where no collateral was given.

The business suffered badly as there were some issues with our buyer which is major corporate in India. The bank was well aware that the business was suffering and even wrote to our buyer directly. However we do not have access to that communication.

Me and my partner had a dispute and we decided to close the company, my partner eloped to the UK without informing anyone.

The company was closed down suddenly as we were in a rented premises, and we did not have the resources to meet rent and other overheads. The proceeds of raw material sale etc which sold less then a third of market price were used to pay off govt dues like Excise duties, TDS, VAT, ESI and employee salaries.

I was also living in a rented premises and changed houses. And just came to know that the bank has filed a case with the DRT. I did not receive any summon as I had changed address.

Now I do not have any assets / property in my name and since the last 2 years since the business closed down have been living off support from my father and I had to move in with him as I could not afford rentals.

Now I want to understand what could be my liability here, and wether any problems can happen for my father.

Please advise.

Lic death claim

Dear Sir/Ma'am,

My brother expired on 22 April 2015 in a road accident. he had an LIC policy for which only one premium was given.

His wife claimed money from LIC on the basis of same policy for which she received one amount, for the next amount (i.e. death) the LIC said that as per the police Final Report the case is registered under 279 and 338 which proves that he was not careful while driving and he died due to uncontable driving and not being careful.
therefore they have rejected the claim. now in this condition what should we do as at the time of death no body was there then how can police claim that he was not careful. Secondaly up police themselevs were not serious in investigating the matter. it is just that they have to produce the FR copy they have given the same to us and LIC has rejected the claim on the basis of the same.

I request experts to please advise urgently.
