Compassionate appointment

Mr X a Central Government employee expired on 27.5.2008. His wife submitted application seeking Compassionate appointment. Since the wife was employed in an aided school and also because of other factors, her application was rejected. On inquiry it was found that the mother (wife of the deceased employee) had mental problems and that she was not supporting her only daughter. The daughter sought the help of Women's Commission and as a result she was put in a hostel. Later the deceased official's brothers took custody of the girl. Practically the girl is an orphan. The daughter, who was a minor at the time of death of the father, on attaining the age of 18 preferred seeking compassionate appointment. Can her case be considered?

Salary on hold during notice period?

Hi, I am working in India Pvt. Ltd. It has a employee strength of 6 in all.
I have few questions:
I joined the company in Dec-2010 with a written appointment letter which mentions six months probation and one months notice period in case of resignation during probation period and 3 months after confirmation. Non issuance of confirmation letter will no mean confirmation. It does not contain any clause of bond either during probation or after confirmation.

Now last month on completion of six months, management wanted me to sign a bond of one year equal to my one year salary amount which I denied and hence the only option left was to resign. And post my resignation, they issued the confirmation letter which I never signed, stating I am now confirmed and my notice period is 3 months.

Now post one month of resignation, they came up with the policy saying they will hold my 3 months salary for the notice period and will give it together with Full and final settlement. They even have drafted a policy pdf document for that.

I request you to help me with your expert knowledge on my following questions:

1. How much valid a bond is when I have already served six months and company is not expending any specific amount either on my travel or honing my skills by imparting trainings?
2. How much the confirmation letter is valid and the terms of notice period when confirmation letter was issued post my written resignation. And that too a confirmation letter which I never signed (I think it requires my acceptance since it changes my terms of employment - notice period to three months)?
3. How much salary on hold for 3 months is valid where I am serving the notice period and attending office and its duties in normal hours?

Do you think I have any remedy in the given circumstances?

Please help me, I don't want to ruin the relationship with people but at the same time I don't want to be manhandled by wrong people.

Thanks in advance for your help!

Rishi

Who is qualified for ia

Dear all,

i see that most of the firms esp Big4 employs B.com graduates to do Internal Audit for companies (MNC/Listed/etc. They also do have CA's.

I understand that Statutory Audit needs to be conducted only by a qualified CA. Why not this is applicable for Internal Audit conducted.

Being a B.com they lack competence and skills these remain unknown to clients and presume they are CA aswell.

Should ICAI come up with a regulation or stating who is certified to be called as Internal Auditor first of all and the qualification one requires.?

Also if Internal Audit can be executed by anyone like Graduates / MBA then why become a CA...?

I need suggestion as to how this can be taken forward.

Thanks Indeed!

Pension benefits

My colleague retired from the bank on superannuation. A case is pending in the CBI court in Mumbai where he has been made accused. He is a pension optee. The bank is not releasing gratuity. Whether it is proper on the part of the bank to withhold the gratuity, when it is clearly said that gratuity can not be hold back under any circumstances as per gratuity act. Does pension regulation overrule gratuity act?

The arbitration and conciliation act 1996

What would be the effect under section 32(2)(a) where the respondent objects to the order and the arbitral tribunal does not recognise a legitimate interest on his part in obtaining a final settlement of the dispute. Will such a decision be final?
