We have received a notice from sub-registrar to the society on the basis of complaint from one of the member. The notice is regarding Maintenance amount and the election in society. We received society handover from builder 2 years ago. First year we followed what builder did, the maintenance was incurred per sq ft basis. In second year, as per advisory notice from sub registrar, In AGM, we birficated the services into common service (equal for all) and the water calculated (seprate for 1BHK and 2BHK) but the amount that came was not accepted by the 1BHK owners as the difference from last year's amount and this year was high. Eventually we had to come to calculated ensuring that the budget for society is met at the sametime there is not much difference from last year and this years amount. Which was accepted by everyone except one person who approached the subregistrar and we got notice from sub registrar.
Secondly, regarding election. After builder formed committee in first year, the registrar that came in during the meeting had mentioned that after first year, it is the matter of society to decide on whether to continue with the body or hold election. In AGM, when the matter was brought members consented to continue with body and we carried on. However, as per the notice that we received it says that election has to be conducted.
Please suggest on how to proceed. I want to know in the situation where the body is expired and no election has been held what are the rights of the interim body? In case of the maintenance amount collected, what should we do?

Sir/s,
Authorised Officer (AO) appointed to handle day-to-day affairs and to arrange for election of a cooperative premises society. Socy has two independent saving bank accounts. AO thus appointed submitted his KYC to 1st bank (only) for account operation.
Thereafter a status-quo was obtained against the appointment of AO. The AO has not submitted his KYC and therefore is not on the records of 2nd bank as a signatory to operate the 2nd account. Existing signatories of the socy issued cheque from 2nd bank account but the bank refused to clear the payment saying since there is a dispute they will not pass the cheques.
[1]. IS THE STAND TAKEN BY THE 2ND BANK CORRECT?
[2]. IF NO, WHAT OPTIONS AND REMEDY LIE BEFORE THE EXISTING SIGNATORIES AGAINST THE 2ND BANK?

Letter to Site admin, Mr Sudhir Kumar and Mr JC Vashista
Me or anyone else on this platform come seeking advice mainly because we are unable to afford hefty fees by local advocate.
Just look at the replies from above people nobody seems to be an advocate.
They are simply telling go to police when fault is not ours and give explanation to police.
The shopkeeper though appearing in court is not coming before judge. But he has filed some false NCR in pune police station which is far away from Amravati where we stay.
One thing is jurisdiction. How Pune police station can call one who is sitting in Amravati.
Another thing is shopkeeper is at fault and he has allegedly given complaint that we threatened him over phone. As he is at fault and he knows consumer court will award compensation to us, he is using police power to make us come to police station which is not even situated in Amravati. But in pune.
I am asking advice and these above people are doing time pass and the forum is called LAWYERS CLUB OF INDIA where not a single expert is a advocate.
When I looked at Sudhir Kumar old posts, I found out that his wife is fed up of him because he is not giving much time to her and spending time in posting replies in LCI.com.
He is neither helping his wife by coming to LCI.com nor his replies are helping any people who post their genuine problems. He simply taunts at people who post their problems and he has put a big smiling face which looks pathetic in this situation.
I am not commenting on personal life of Sudhir Kumar. It is his own wife who opened thread on LCI.com. if anybody it is Mrs. Sudhir Kumar who needs to be instructed by Mr. Sudhir Kumar and not you or me.
But again if a lady has problem me or her if it can be solved by Mr. Sudhir Kumar he should give it full try. But should not do timepass in name of helping increase his post count.
LCI.com requires overhauling.

The internal auditors of a charitable institution registered under the Bombay Public Trusts Act, are elected by the general body at its annual general body meeting. Fearing an expose of frauds, the managing committee is not cooperating with the Internal Auditors in carrying out the audit.
Can the accounts of the trust be finalized and the AGM held , without the internal audit report ? Can the statutory auditor complete his audit and issue the report, without waiting for the Internal Audit report.?

My Dad had accident in road accident seven years back (2011) and we filed MACT in rohini court (small causes)on the same year with the help of advocate.
And advocate fee was discussed as 10% initially.
Now we got the judgement and awarded amount is 1308000 with interest.
As per Supream Court judgment court awarded 200000 for initial amount from total amount(1308000). And rest of money fixed in bank for 20 yrs.
5000+5000(interst) paid to me every month from awarded amount.
So my doubt here is how i should pay the advocate. The 10% is on the awarded amount or
I have to add the interest amount also.
