Compliant by Neighbours

Dear Sir,

My wife had a major fight with one of our neighour last week (both were ladies) and unfortunately I got drug into this fight. Since we are new in this area and most of the residents are being staying here for 30 years. The neighbour along with majoirty of the society members have filled a compliant with society against me (not my wife) saying "I have been fighting and harrasing them for 2 years and tried to beat them up. They are ladies alone at home and are afraid that I would kill them".

I am completely stattered and my image has completely been blown out. I dont know what to do. I would like to know :
1) What are the legal options I have to take against them ( I am alone against 10 society members)
2) How can this have impact in future on me
3) Would it better to move out of this locality or to continue

My intention is not to fight with anyone but would like to know how can I safeguard myself in future against this compliant.

Irregularrities in Society Management

Dear Sir,

Our society has been located at Borivali district of Mumbai and registered in 1992.Following irregularities has been carried out in our society since a very long period.

1) No election of the Managing Committee Members has been held since 1998. Only one person(secretary)has been running the society as per his own will without taking care of any rules and laws.

2)Society member has not been given any statement of accounts since 2002-03. No AGM or General Body Meeting has been held since 2003. During 2003, society was having a FD of Rs.20 Lacs app. Thereafter,present financial position is not made known to any members.

3)During 2004, a painting work of the building has been carried out at an app. cost of Rs.15 Lacs withour taking the consent of the General Body of the society.

4) As society has 52 members, as per the Bye-laws, it requires to have a committee of 7 person. However, there is only 2 members in the committee (secretary and treasurer). In bank a/c, the name of the chairman is the name of the person who has sold his flat in 2004 and at present he is even not a member of our society.

5) Now, the secretary is planning to increase the maintenance charges by 50% without the approval of the members.

7) Secretary himself has converted his split parking place in to a storage room with a cement concrete wall.

8)Even, 2 committee members, has not given any indemnity bond as required under Maharashtra Co-op. Sco. Act.

9) Secretary himself behaves as the landlord of the entire building and treats all the members as his tenants without having any care of Bye-Laws, Rules and Laws.

Sir, in light of above condition, please advice on the matter of best possible action against the secretary and the authorities where we can approach for the same.

not signing indemnity bond under mcs act & its effct

maha,co-op socty.[amended rules 2002]has made it mandetory to furnish signed indemnity bond by all m.committee members within 15 days from their election.my Q. is are the resolution/decisions/expenditure etc. under taken by the committee get nuliifed/ineffective if thy have not signed the indemnity bond ?

passports

a person has three different passports with same name and photograh but different surnames and addressess...is that valid??? if not under what provisions/law can he be prosecuted???

Software Bug Noticed

Any online portal should never allow the user to invoke navigation to "Back" for security reasons. But LCI online portal allows it as it is amply seen that duplication in the posting of queries. Users tend to correct the mistakes in their first postings by using "Back" Button and then post again. It is always considered to be a dangerous proposition under Gateway Payment system or even normal browsing of any sites related to financial implications. In other words, if a user does not log out by mistake anybody can use this Back Button and engage in all transactions. I request the Technical team of LCI to look into the software and fix the bug.

Example: Today I have posted a query with having typing mistake to the title. I utilized the software bug and got it corrected. This should never be allowed for any secured website portal.

LAW NEWS:

NEW DELHI: Karnataka High Court Chief Justice P D Dinakaran, whose elevation to the Supreme Court was halted, has been asked by the apex court Collegium to go on leave.

Highly placed sources said the decision was taken against Dinakaran, who has not been performing any judicial work since December last, as several representations were received that the judicial work of the high court has been hit.

Sources said the collegium has also cleared the name of the acting chief justice of the Delhi High Court Justice Madan B Lokur to be appointed as the Chief Justice of the Karnataka High Court.

LAWMAN'S VIEWS:

Supreme Court must intervene into the affairs and functioning of each and every Government Department and Organisations and Fix Accountability for Delay in the discharge of official responsibilities and duties of Public Servants.

Experts to offer their opinion on my views

Securitization Act

the bank has approached the civil court about 4 years bank obtained the decree against the borrower and now they have issued notice under securitizatin act, can they? how far it is correct? i have the feeling that they cant take any action under the securization act, is there any citations?
