Form C is issued when we purchase goods from outside the state on concessional rates.i.e @ 1% Or 2%.
Now my Question is.
1. if we are liable to issue c form when we purchase goods outside the state which is located in SEZ or exemption zone who charges no cst in bill. but mentioned on bill that sales is against form C.
2.if we are liable to issue c form for tax free goods purchased from outside the state.

respected sir,
my self ashish kamthania advocate and practicing in taxation in rampur up.
near by me a associate of two non law graduate persons are open his office and start practicing in taxation (income tax, vat, service tax & others).
both of them opened joint office, named
R.M.ASSOCIATES
first of them is m.com but never completed his LL.B. but on the office flax board he write his name and shows degree M.COM. LL.B.
and second of them is phd in commerce and now doing LL.B. but on the office flax board he write his name and shows degree Ph.D. M.COM. LL.B.
but on the office flax board both of them not write advocate but start practicing as advocate. they effects my practice my 50% client is well known of them and those shifted from me to them.........
what is the write procedure to save my clients and legal proceeding to save those clients who is going to cheat by them.

Dear Friends,
one of my client is a Small Scale Industries. They are doing Galvanizing activity only on Labour Charges Now from the Union Budget 2011-2012 Galvanizing process is amount to manufacturing activity., till we are paying service tax on the said process. Now which Law will applicable "Service Tax or Central Excise". please advice.

sir, I am a native of Ercord which is a tourist place and it is comes under municipality administration. In the entrance of the town municipal authoririty charging a sum of tax to entering in to the town. But the administration charging the same amount to the local people's vehicles either own vehicles or taxies. Is there any chance to stay the municipal authority to charging the amount to the local people through any suit or writ petition. If it is yes please send me some cytations and caselaws. thanking you

I received letter dt. 25/08/2010 from ITO that my case is selected for scrutiny u/s 143(2) and the case has been selected through CASS.When i went to dept. in Sep 2010 i was told that currently time-bar cases are considered so i will be called in year 2011. The assessing officer was then transferred and new officer has sent a new letter dt. 5 01. 2011 wherein he has asked very exhaustive details which are mind boggling. In my opinion CBDT has directed that for case selected through CASS only relevant detail pertaining to point under question should be called for and exhaustive details are not to be called for. Am i correct in my contention ? If it is so how can i convey ITO to stick to the point for which scrutiny is called for ?

I am salaried person & willing to do trading in chemicals & speciality chemicals from mumbai.
pl suggest me what type of registration i need to get.
is it necessary to get excise registration & sales tax registration?
if i am buying chemicals from original manufaturere & selling to onther user. then excsie duty & sales tax i am paying on buying material, how can i pass it on to my customer without having excise registration & sales registration.
without this registration or having any one of this registration is it possible to do trading. How to get this registration. what is procedure, how much costelier,time consuming & what are all documents needed.
i understood that small scale manufaturer do not need to pay excise duty. same is applicable to traders also? in that case a original manufacturer who raise the bill with 10.3 % excise to me. how this is adjusted or passed on to my customer.

Ours is an Excise Unit. Let me know the legal procedure for disposal of Central Excise and other Records older than 8 years.

Can a royalty (or any tax or fee) be imposed, for the first time, without the authority of law or a notification not having the force of law (i.e. through a mere executive decision)? If not, continued payment of the levy for more than three decades would be held out as an estoppel or limitation for seeking relief from the Court?
