Capital gain on house sale

Hi,
i booked a apartment in August 2007 with downpayment plan(40% self paid, 60% finance) and got the possession in 2009 and get registry done. This month feb 2012 i sold this flat. Now after lots of netsearches and comments from my CA friend, i am confused that how to calculate LTCG. Should i take allotment year or registry year to calculate cost indexation?
Thanks in advance. Please advice.

Tax treatment to shares received under esops by nri

A NRI Employee working in US in a subsidiary of Indian co.is granted Shares under the Indian Co.'s ESOPS Scheme..He is NOT on Payroll of the Indian Co.He does NOT have any property or Investment in India. His Status is NRI. He exercises his option by making payment from his NRE Account in India. What will be Tax treatment to him, when he sales these shares?
1.Will he liable to short Term/Long Term Capital Gain Tax? if so, at what rate and under which clause of ITAX Tules?
How the capital Tax would be calculated?
1.Difference Between Sales Price and Purchase price or Market Price prevailing on the date of EXERCISING the option and Purchase price.
2. Will this be considered "Income From Other Sources?"
3. If he includes this income of india in his income in USA, declares in his Returns there and Pays Tax there, is it necessary to pay Tax here in India or get Refund?
Will this be covered under DTTE (Double Taxation Treaty Agreement?
Shall appreciate your valuable advice/guidance.

Service tax

Sir,
My client is service tax assessee under the services"cable operator".they are importing set top boxes and availing credit on the admissible part.the set top boxes are capital goods which are sold to our subscribers only.they come under "deemed sales".Also VAT is paid under sale of goods act.
The service tax dept demanded service tax under the services"supply of tangible goods".My client refused saying that the goodsare sold and VAT is being paid and hence is out of the purview of srvice tax.The dept confirmed the demand and the matter is before CESTAT.
Now the dept says that as thecapital goods (set top boxes) are sold and as VAT is being paid the Cenvat credit on account of these capital goods must be reversed. They say that the credit on account of capital goods cleared as such should be reversed.

But as we are in the business of cable operators the set top boxes are essential to our main business. Whether we should reverse the Cenvat credit ?
