Respected all Experts/Members,
I am facing problem in finding a way in one case i request all of you to help and give me right guidance to solve the problem. My query is as follows:-
My company is a manufacturing company of the prepaid recharge card of BSNL,IDEA, RELINCE, AIRCEL,Etc and Labels of various companies like Indian Oil Corporation, Vankeys,ETC. situated at Pune (Maharashtra), my marketing persons are facing problem to get orders from local companies due to Octroi. For us a manufacturing cost of a card is of Rs 0.45 (i.e. 45 paisa) on which the MRP is printed as Rs.100/- now when we take the orders of the local telecom companies Octroi people are obstructing us an telling us to pay octroi tax on the MRP and not on Invoice amount. which is not at all possible because the manufacturing cost of one order is of Rs.1,00,000/- then the Octroi tax is of Rs.4,00,000/- . If we oppose the Octroi people then they seize our goods and our client will be in trouble and our business too. Now my management had asked me to find a way so that we can get local orders also.
Please help me n tell me how to solve this problem. I came to know that some telecom companies filed a writ petition for similar facts please any of one member can give me such citation. please suggest me how to find solution to whom i should meet ( Concerned authority) and tell them? This is injustice on companies because they can not get the business from local. Please show me right path so that i can find a way to solve this problem.
Thanks for giving me your precious time and reading this question , Expecting help from all of you.

I am a manufacturer of readymade kidswear.
As per the exise duty imposed on garments exemption is given to the people have turnover below 1.5 crore. My turnover was around 60 lakhs in 2009-2010. In the current financial year 2010-2011 the turnover is around the same figure. As I fall under the exemption limit of excise duty, do I have to register with the excise department? Do I have to fulfil any of the excise formalities? What is the excemption limit to take excise registration?
Please Suggest...
Would the learned Experts guide enlighten me in the following?
My question is, in the financial year 2011-12;
1) Will House Rent allowance paid by the Employer to me be considered as my Income & be Taxed?
2) What rebate I will get if I take up a house against rent? Is there a maximum limit for getting rebate towards House Rent paid? Is it Rs.24,000/- per year only?
3) If my Company gives me a quarter or leased accommodation taking lease in their name, will that leased amount paid by my Company to the landlord be added as my Income & Taxed?
4) Similarly, will the amount paid by Company to me as Car & Driver allowance be treated as my Income & Taxed?
5) If my Company allot me a car along with Driver, will the amount paid by my Company towards the said Car& Driver be treated as my Income & taxed?
6) What will be benificial, taking the above allowances & then leasing house in own name & hiring driver & Car myself or
Telling the Company to provide both the facilities i.e. free house & Car to me?
7) Is the answer to the above questions be same for a resident Indian & a Singaporean Citizen who will work in India in the year 2011-12?
Thanks in advance.

I had purchased a plot Twenty years back. Subsequently, majority of this was shown under reservation for construction of Road, in Proposed Development plan of Municipal Corporation. As a result, neither they allow me to carry out any construction nor nobody was ready to buy the same. Their policy for compensation is not clear. Whether they are going to give the Transfer of Residence (TDR) or Cash or anyother method. Even if they do so, we do not know as to when ,how much, what will be the expenses involved for getting the TDR and what will be the price of such allotted TDR, after allotment to us. Everything is Uncertain and in limbo.
However one of the builders has agreed to buy this plot with knowledge of Reservation. However, he has agreed to pay the price which is much lower than govt.’s Ready Reckoner (So called market) price Applicable to OPEN CLEAR PLOT WITHOUT ANY RESERVATIONS, though he has agreed to pay stamp Duty at the Ready Reckoner price.
Considering the above facts and my age (70+), I would like to get rid of the liability and get the money for our old age.
But I would like to work out the Long Term Capital Gain Tax on Sale price and not on Ready Reckoner price.
Please let me know whether the Income Tax authorities would accept this and is there any clause under Income Tax law, for representing the above case.
Thanks and regards.

We have Industrial Trainees who are on Contract with the Organization for one year.
As per terms of the contract, only the best trainees will be confirmed as Employees.
As per APPT will the Trainees be termed as "Employees"? Will this contract be a employer-employee relationship of a "regular nature"?
2. We are paying a Stipend to them. Is the Stipend a "Salary or Wage" as per APPT?
Two different CTO's are of differing opinions.
