Bangalore: Khata Transfer

This question is specific to the properties in Bangalore.
Whey can one apply for khata transfer?
Is there a sepcific timeframe in which one has to apply for khata transfer? OR any time is a year one can apply for khata transfer?
I have hear about B khata? what is it?

open terrace attached to flat ..unsold by the builder

my father builded a building in mumbai suburban area in 1976 of 10 flats ,2 garages & 3 open parkings.out of 10 he sold 9 and kept the flat on 3rd floor with attched open terrace for ourself.society was formed in 1981..now we want to give the conveyance to the society but they are not accepting the terms that garages and terrace attached to the flat belongs to the builder..what should be done they want the private terrace and garages to be mentioned as property of the society along with the common terrace on the top floor.nobody has any sale agreements of garages nor parkings has been alloted to any1 ..in b.m.c plan of 1977 the open terrace had a wall which was taken inside the living room before the formation of the society.now society claims that along with common terrace ,.the private terrace on 3rd floor also belongs to them and the parkings and garages are also part of the society....any 1 can help what can be done???? can it be mentioned as our property in conveyance????

REGARDING - PATTA,CHITTA,ADANGAL COPY

I HAVE PROPERTY AT PALLIKARANAI,CHENNAI - IN 3 TO 4 FAMILY MEMBERS NAME.
I HAVE APPLIED FOR PATTA,CHITTA,ADANGAL COPY
AFTER SUBDIVISON. MORE THEN 6 TO 7 MONTHS PASSED BUT YET THEY ARE NOT ISSUING THE SAME EVEN AFTER REGULAR FOLLOW UP BY VISITS AND PHONE CALLS TO VAO AND THASILDAR. THEY WERE CONVINSED IN ALL THE WAYS. EVEN THEN THE ARE DODGING. PLEASE INFORM WHAT IS THE OTHER WAY TO PROCEED.USALLY THEY USE TO CLEAR MAXIMUM 2 TO 3 MONTHS.THEY ARE GOING ON WITH VARIOUS EXCUSES.FESITVALS, RAIN, LEAVE, TRANSFERS, DISTRIBUTIONS ETC.. AND NOW VOTING.
do we have any rights to demand ?

Tripartite Agreement reg

Dear Sir,

I am an advocate. I have a friend who is a land owner. He wants to put up a group housing project in his land. we have also identified a builder. So is there any tripartite agreement involving the land owner, builder and me. My scope of work will be obtaining building sanctions, sanctions for change in land use and marketing the group housing project. can any body give me a draft where in i can tune the same to my need. Very urgent please. This is my first project. I dont want to loose it please

Uthara pathra for biforcation site of 15*40 out of 30*40

Hi All,

Thanks for your update for my previous query. I have purchase the land of 15*40 out of 30*40 which is DC conversion land with "A" Khatha and Khatha is also get transferred to my name but Bank executive is asking for Uthara pathra for the same with Khatha. when I have asked BBMP people who transferred Khatha to my name they said that Uthara pathra will not come for biforcation site (15*40 out of 30*40). I am bit confusing with this.

Can any please advise.

Power of Attorney related to Immovable Property and it is Registered

The following provisions relating to Power of Attorney whether it is GPA and SPA have been mentioned in which Bare Act or in which Section of any Act.:-


Provision :-
1. It is the rule that after the Death of Power of Attorney maker the Powers which are given to attorney Holder also relinquished.(comes to an end.).

2. Then he (Attorney Holder) has no right to do work on the basis of Power of Attorney.....

purchase of land

if the vendor is not agree to sale the land through cheque payment and the company is bound to purchase the land in cash (the company has cash balance to purchase the said land), than whether this expense is allowed for deduction as the company has the business of selling and purchasing land.

if it is disallowed than what are the limitation of cash purchase.

Purchase of the share of property

Dear Experts

There were four claimants (all sons) to the property of my grandfather. They had mutually divided the property amongst themselves through a Property Agreement. Now my father had been able to purchase the share of one of the property-shareholder at a cost of Rs. 5.50 lakhs.

My friends and relatives are advising to get the sale deed duly indemnified through Registration i.e. get the property registered in our name. I suppose the registration will cost approx 1 Lakh as per our municipality is concerned.

Though I have least information about property sale-purchase. Out of my curiosity I want to know if the same share of property can be gifted to us. If yes, whether there will be any financial burden to us.
There are every scope that one brother can gift the share to his brother without any financial provision.

In short which medium of obtaining a property you will advise? Registration or Gift. And what would be the financial burden to us?

Kindly also enlighten the Pros n Cons of dealing in property.

Parental property seperation

My grand father was 3 brothers.After partition he has inherited a big piece of land(in 1960-65).
He has two sons(my father and my uncle)and 1 daughter.He has also purchased a house and registered equally it in the name of three people(in 1980-83).1)my father,2)my grand mother,3)my uncle.The area of this purchased house is half of the area of the land inherited.This house is 200 mtrs away from the land inherited.After marriage of my father and uncle, my grand father built a new three floor house in half of the land inherited.Due to bad behaviour of my uncle my grand father-mother and my parents permanently shifted to newly built house(in 1990-92).From then till now we are aquiring this newly built house and the adjoining land. my grand father died in february last year.My house value is 60 lakhs and value of adjoining land is 30 lakhs(total=90 lakhs).Value of house aquired by uncle is only 45 lakhs.There was a mutual agreement that after the death of my grand pa ,my father will be given the ownership of newly built house with land and uncle will be given the ownership of purchased house.Now after death of my grand father my uncle is not ready to withdraw his rights from my father's house.He says that he wants either half of the land or 15 lkhs rupees so that both will get the property of equal value.Grand mother lives with us.we cant get my grandmother's share transferred in my father's name because my uncle will never let us do that.Se is gradually loosing her conciousness.How can i get the house registered in my father's name.Please suggest something which can be done easily.There are three four renowned lawyers in our blood relation practicing around there,thats why my father hasitate to go to them because he does not want to disclose the inside family matters to them .please help.....
