Dear experts,
I am one of the partners in a business of 5 partners. I was never really involved in the business, but the other partners cheated the civil supplies department and the bank and our business property was declared as NPA. Our house( owned by myself and another partner) was also a security for the business. The bank had given us the option of a one time settlement by reducing the amount owed, but due to differences with the partners, we didn't make use of this settlement. Now the property of the main business is sold off by the bank for 7 crores. The total amount owed is 7.7 crores. The bank is now planning to auction my house as well as it was another security.
My question: If the house is sold for an excess amount than owed to the bank, would they give the excess amount to the joint owners of the property or would they give this excess amount among all the 5 partners of the business? I would like to clarify that this house is already a part of a civil property dispute going on in a family court.
Also, if they give the excess amount to the joint owners of the house- how would they divide this excess amount among the 2 partners?

I am tanent occuping 210 sq ft Carpet area since 1970 in my building at Kandivali Mumbai surbaban Area, My landlord/Developer offers me in proposed new building 300 sq ft. Area which is including fungible area Saying he is following Rent Act under which he is not oblidged to provide carpet area of 27.88 Carpet as per DCR SEC 33(7)A AND FREE 35% fungible area please advise me

My mother died on 2017 and left one plot having area 2030 sq. ft. which was purchases in the name of my mother. On 1/3 area of plot I have constructed a house.
My brother is making a house in 2/3 area.
Sir,
Due to transfer I am not living in house made by me. I want to earn from that house by rent.
But whenever any tanent come my brother did not allow to enter in my house.
My father is alive.
How can I sell my house ?
How can I register my house in my name?
How can I rent my property?

The registered will is for the properties in chennai. Is probate compulsory for this?

Hi my father purchased 200 squad yards of land 20 years back on my mother name.. They promised to give 100yards on my name duriny marriag but, unfortunately my mom expired recently. EC is on my mother name after her death we took legalized certificate as well but when my dad is trying to make a registration on my name the sub register rejected it saying that this property survey number comes under waqf board can someone help me out of it.. We really don't know what to do now.. Is there any solution please advice on this...

Dear sir, We belongs to Hindu religion and my father having 5brothers and my grand father given gifted a property ( in form of each house to each son ) by making notary in 2001 and 2004 my grand father expired and in 2016 my father gifted property to my mother and it was registered and due to some financial problems we want to sell our property and just 15days back my father's brother who stays opposite to my house and came to us along with area elders and he himself orally (not in written) told that he want to buy our house for 33lakhs and after 15days he is going to give advance like this he told and went and 15days we asked him about advance i,e token amount and he told the rate is high instead of 33 lakhs he can buy it for 25lakhs or otherwise you can sell to others and after 2days back the other person came to buy my house but my fathers brother stopping them to buy my house like this is disturbing us and he is saying he will go court.Sir, please suggest me how to sell our house because we are serious financial problems. Thanking you

Stay order on property
Hi Experts,
Our neighbors constructed thier house without leaving any space. We complaint with BBMP but there was no help. Thier house is construction is done. Now we started constructing top floors, we had g floor till now. To take revenge our neighbors have put a court case on us mentioning fake reason that while starting top floor construction we have extended our existing compound wall in thier property (encroaching case)and got order passed to maintain status quo on schedule property. There is no notice to us. What should we do?
