in a jointly held flat in our housing society in Mumbai, original member sold the flat for which an agreement of sale was jointly made by the original member and the joint holder being his wife, regisered but before making an application to the Society the original member expired. Hence the joint member made an application for transfer of shares and interests to a third party. The original member in fact had nominated his two daughters as the nominees for 50% share each. Can the Society transfer the flat to the buyer of the flat ignoring the rights of the nominees since the agreement for sale has been made by the original member and the joint holder ? The buyer has sent a lawyer's notice to the Society threatening to go to court in the event of non-transfer. The buyer nor the seller has provided any letter of indemnity to Society for which the Society is continuously following up which has not yet vbeen complied with by both the parties.
Husband dies leaving behind his wife. No children or other heirs. She wants to sell the flat which was in joint name of her and her husband. What procedure she needs to follow? Is getting legal heir certificate necessary ? If yes from which authority she will get legal heir cerificate? Tehsildaar or court or municipal corporation. Is there any stamp duty she needs to pay? If yes how much? And how much time it will take?

Hello
I had performed a sale agreement in 2006 and had received 25% of the advance. Due to some reasons buyer never turned up for registration. Now from no where the buyer lands up and demands the advance paid back. Is the agreement still valid.

whether the Govt of AP can grant the Mining lease to third person without consent of the land owner to do underground mining operation, when asked the department, they told that, land owners(farmers) have only surface right, govt have mineral right, hence lease holder can do underground mining operation without disturbing the surface of the land owner. i.e lease holder can enter from adjacent land in to farmer land in below 30 meters. is it correct in law. Please advise.
