U.p. zamindari abolition. consolidation/ chakbandi

Greetings!

In a town of Bulandshahr, after the U.P. Zamindari Abolition came into force the State of U.P. started realizing rents from all the tenants/occupants of every khasra, agriculture of otherwise, on a false claim that after Z.A. act all lands have vested in the state (except two plots where there was actual Abadi).

There was a controversy regarding the boundaries of town area, thus the applicability of U.P. Zamindari Abolition Act. In 1962 while the matter regarding the boundaries of town area was pending in a civil court, the state of U.P. carried out consolidation of the entire town, including the admitted abadi plots. As a result, not only all khasra (plot) numbers were changed but also their size. U.P. state was defendant and we were as plaintiff in this case. Judgment came out in 1963. DJ upheld the civil judge’s verdict on 1966. No further appeal. No U.P. Urban Areas Zamindari Abolition Act ever came into force in this town. Court admitted the list of all our tenants on agriculture or non-agriculture lands.

As I know, consolidation Act would apply only to the areas to which the provisions of the Zamindari Act would apply. We have tenants in agriculture lands through lease/patta given before and after Z.A. act. The lands where we have these tenants are according to court’s verdict are inside town area (urban) limits, but according to government they are outside. Sometime after consolidation in 1962 government issued Bhumidhari sanads to the occupants these lands. They got their names mutated in revenue records.

Now once again consolidation proceedings have been initiated and they are presently in progress. Do we have any rights left in these lands, which were confirmed by the court in 1963 and again in 1966? If yes, how do we proceed?

Gpa cancellation

my father had had signed a power of attornity.later he cancled the gpa and tranferd the land to another per.but as my father had signed the poa the party the filed a case claiming the property.please let me no your opinions

Effect of bye-law no. 65 of housing co-op society.

I had given Flat Transfer Application along with necessary documents to the Secretary on 23.12.2018 but he has not communicated any reply to me till today, though more then 3 months has passed.

In such case, can I become a member of the society automatically as per bye-law 65(g) and as provided under Section 22(2) of MCS Act ? What action I should take now, please advise.

Landlord removed electricity

I am from hyderabad. I am staying in appartment from 13years. Presently i am facing some financial crisis and not able to pay rent to landlord from 6months. Today my owner remove MCp from meter and disconnect electricity. Can u please guide me the way.

Cheating by builder

I have made an agreement with a builder in Guwahati, Assam to purchase a flat in the year 2011.But till date the falte is not delivered to us.We have made all the payments as per agreement.and he was supposed to deliver the flat within 24 months from the date of agreement.But till now only 60% work is completed.During this tenure we have served him many legal notices to which he have replied, but failed to comply with delivery date every-time.
What is the way out for us now??

Witness to motd

Purchasing a property through Loan from Bank. For MOTD Bank is insisting that the witnesses should be blood relatives only. I am alone here and none of my relatives are available. Is there any other remedy? Thanks in Advance

Land acquisition act - agp enquiry

Hi Team,

We have had a road widening due to the upcoming Metro rail in hyderabad.
And there is a case running under Land acquisition Act - to allocate the compensation.
The case is now at the stage of "Enquiry of A.G.P"

1. should we be pursuing with the police authority to prove my ownership to the property.
2. Who is AGP and how can I identify the AGP for my area.

Txr deed for parts pf property, one has direction, one not

1. My father has given property to us three brothers...
2. When my father did transfer deed for my brother, he wrote that - he is transferring 2/3 part.. of right-side.. and keeping remaining left side for himself.
3. When my father did transfer deed for me, somehow it only contains words that - he is transferring 1/3 part.. there is no mention of sides..
4. Both the transfer deeds have gone through mutation.

Now my question is =>
Q.1 What is my share ? The overall 1/3rd or the part specific to 1/3rd leftmost part?
Q.2 Also - am seeing some words in Abhyukti/Remarks column such as "Registry No ABC , peshkarta father-name, dawedaar my-name and other-5-7 people names in that". Am not sure, if this matters somehow. Do they somehow have any relation to this property? We dont even know them... How do we get these names removed from Abhiyukti Column ?

Delay in issuing nomination form dully endorsed by society

Respected Sir / Madam,
The undersigned has been submitted nomination form dully filed and signed to our Co-Op.Housing Society in the month of July, 2018. Despite of repeated followups and requested the committee office bearers are not giving the copy of form dully endorsed in their record.

This documents is very important document and the office bearers should take steps to prevent any awkward situation in the eventuality.

Kindly advise me for further appropriate action.

Mortgage.

I WANT TO PLEDGE MY PROPERTY IN MUMBAI MAHARASTRA AND WANT TO AVAIL BANK LOAN AGAINST MY PROPERTY.

THE SOCIETY IS NOT GIVING THE NOC TO BANK AS PER BANKS NOC FORMAT .THEIR ARE SEVERE DISPUTES BETWEEN THE COMMITEE MEMBERS [ NOTHING FROM MY SIDE ].I DONT HAVE ANY SOCIETY DUES TO PAY .EVEN THOUGH THEY ARE DELAYING THE NOC.THE BANK VALIDITY OF SANCTION IS OVER ONCE BUT STILL ONE WEEK EXTENTION THEY HAVE GIVEN.

IS POSSIBLE TO DO REGISTERED MORTGAGE WITHOUT THE NOC FROM SOCIETY INSTEAD OF DOING EQUITABLE MORTGAGE.

KINDLY ADVISE IN THIS MATTER.
