i want to know that in case of dwelling
house if there is partition of property between two brother who have aquired it through separate sale deed from their father
in lieu of money and now one of the brother wants to sell his portion to a third party ,then is there any right of pre-emption or first offer arise for the other brother?they don't share good relation.

Plz tell me what are all the steps involved in getting Probate of the Will.The will is registered. What documents are required to be attached with the petition/application? what is the court fee payable and under which act/section for property valuing Rs.30 lacs in new delhi? normally how much time it wud take to get probate from the court? is state also to be made party to the proceedings ? Do we have to file a complete Petition or it will be just two three pages application.kindly advise all the minor aspects of getting the probate.

Can a sole proprietor executed a gift deed in favour of himself and with others?
Eg. "ABC" is proprietor concern represented by sole proprietor "D". sole proprietor "D" purchased immoveable property is the name of ABC. now ABC represented by sole proprietor "D" wanted to execute gift deed to his sons and himself.
Wheather such gift deed is valid or not.
I bought a property in Mumbai where I am residing and working since year 2000. I was not helped by my parents till date towards day to day working. I was married in 2004 now have a kid too.
The property was bought with a loan of 16.5lac, 4lac my own saving contribution and 1lac contributed by my father in the year 2007 when I bought home. Father expired in year 2008 without a will.
Father left behind the house in varanasi and his business. It was decided that the business would be taken care by my younger brother under partnership agreement. Now mother want to make a will where she want to divide the property and all assets equally between both brothers.
Brother does not want me to be owner of varanasi home b’coz I have a home in Mumbai. He does not want me to be the owner in the business or shop b’coz I am working in Mumbai. If I do, then he needs a equal division in the Mumbai property too, which is in my and my wifes name.
I was working in Mumbai since 2000 and never asked for any help from parents nor did they helped me in anything to set me up in Mumbai. Later when father started visiting me quite often in year 2007-2008 he realized and offered me to help clear loan by Rs5000 a month for eight months then stopped in march and then he expired in may. Since then I have not taken any mmoney from varanasi.
Now how to settle the whole will thing for mom as she know nothing about how to divide the assets and property. She has insurance policies which is being paid from varanasi partnership business managed by younger brother and a FD.

This people often resort to buying small plot for their retirement benefits. In the era of SEZ,INDUSTRIAL ACQUISITION, HOUSING ACQUISITION,slum clearence acquisition etc takes away the retirement plan. Further the SEZ IN Principle approval they realtor/sez company simply marks some land even though they have not bought or entered into agreement with the owner of the land and apply for SEZ and also display in their WEB as if they are going to come up SEZ.It spoils ordinary citizen bread and butter.What are the course of action we can take against the aggregator or realtor by CIVIL AND CRIMINAL COURSE OF ACTION?
WHat is responsibility of the govt department when it is brought to the notice of ?

a. how much is a standard acre under Tamil Nadu land reforms and fixation of ceiling act (for both dry lands and wet lands)
b. can a society registered under Societies Registration Act, claim any exemption from land ceiling.
c. if not are they entitled to apply for permission for holding excess lands.
