Trademark opposition/new application

Dear Experts,
I am posting my query once again as the last query got mixed up with other query.

The record with the Trademark Office has a date of dispatch of TM 5 on 25.02.2011 and the client must have received it after that, however the client is unable to provide the exact date as to when actually the TM 5 was received.
Now the TM Office says that the 2 months stipulated time to reply back has to be counted from the date of dispatch of TM 5 from Trademark office for applicant has expired. If that is the case then the stipulated time ends on 25.04.2011 (2months).
Now being the month of November 2011 the application will be abandoned in due course. The same is still as opposed in the public site.

My question before you is whether there is any way TM 6 can be filed on this date.

Secondly whether the date of dispatch of TM 5 is to be considered correct.

What is the remedy to save the application.

Or should a new application be filed as no intimation was sent from the Trademark Office in this regard.
I need your advice.

Reply to opposition tm 6

Dear Experts,
My client has received the opposition TM 5 and from that date already two months has passed. There is no point in giving reply in TM 6 anymore as the mark is liable to be abandoned in due course. Suggest me is there any way the application can be saved.

Parental property

Three bothers and three sisters (my father is the eldest). My Grandfather has divided the property among three sons. All of them are staying in their own part. But the will is not presented post my Grandfather's death. Hence we are not being able to do the mutation of the home. The executer of the will is husband of the 2nd sister. He says he doesnot have the will. My father is stuck as he has a zerox copy of the will. How can we claim our part as per will, kindly suggest.

Infringment of idea

Dear sir, i have applied to the patent office in Chennai in the year 26-8-2008 for the grant of patent in cascading marine hydro power generation technology.I have used one object called PIPE for power generation and this is a New Technology to My first application date:26-8-2008,Application number:2065/CHE/2008., My second application date:24-2-2009,Application number:385/CHE/2009.,My third application date:10-8-2009,Application number:1902/CHE/2009,I have 2 Pct applications also.
The question from my side is i have a serious problem and i have noticed my idea got copied by an American company and this company applied for grant of the patent in the year Issue : Date:
June 14,2011;and a Filing : Date:
April 7, 2009.
This company has received big publicity in America and approached the public and collected more than 3 million US$ and also a grant of 1 million US$ from the govt of America.
I want help to file my OPPOSITION to oppose the grant of the Patent,how to proceed in this legal issue i don't have any direction any possible help from lawyers club of India.

Mother property - eligible rights to all duaghters



We are three sisters and there is no brothers. My mother having one building and cost of building it is around 20 lacs.


The issue which we are facing my mother was nominated that property rights to my elder sister son name (after her life time ending).

As per law how it will be divided that property and on mother properties all sisters will have equal rights or not?

In case if we go to court against this property can we get equal rights or not?

Kindly advice me ASAP.

Validity of clauses in a registered partition deed, bangalore

A house wife bought land and constructed a house and this property was registered in her name. Her husband was a Govt Servant. She had not written any will and after a sudden illness she expired. The husband and the children got together and got a partition deed done in which one single house was jointly shared by the husband and son. There was a clause in the Partition deed that post the husband's death the portion of the property which belonged to husband would be transferred to the son. There was also a clause that any kind of dealings with the property should be done with the written agreement from both the parties. The husband after few months of the partition deed has made a death will that post his death the portion of the property that he owned should go to someone else. Does this death will stand valid? The partition deed clearly mentions that the property was self acquired property of the deceased woman. Please confirm if the death will is valid or if there can be any legal course of action which can be taken by the son.
