Copy right act

SIRS,
I HAVE QUESTION, RATHER MY DOUBT , TO PUT BEFORE YOU. THAT IS , CAN ANY ONE EXPLAIN WHAT IS THE DIFFERENCE BETWEEN " ISBN" NUMBER AND " COPY RIGHTS ' OF A BOOK ?

I HAVE READ THAT _"Section 9 of the Copyright Act requires for establishment of an office to be called the Copyright Office for the purpose of the Act. The Copyright Office is to be under the immediate control of a Registrar of Copyrights to be appointed by the Central Government, who would act under the superintendence and directions of the Central Government. The Copyright Office is currently located at the following address:
4th Floor, Jeevan Deep Building
Parliament Street
New Delhi - 110001
Telephone No. : +91-11-23362436 ........."

AT THE SAME TIME , I HAVE ALSO SEEN ON NET THAT ....................

"......ISBN stands for International Standard Book Number, a unique code that can be assigned to a book.

While an ISBN is not required to publish a book, it is a good idea to get one for your book, specially if you want to sell it through standard book distribution channel. For selling it only through Pothi.com, you do not need to have an ISBN.

ISBNs are allotted to publishers. Books on Pothi.com are usually published by the authors or their relatives individually. Earlier ISBNs were allotted only in blocks. But the good news for self-publishers is that now individual ISBNs can be allotted to the self-publishers too.

What more - Getting an ISBN in India is free. You need to send an application to Raja Rammohan Roy National Agency for ISBN. The following details should be included in the application:

Title of Book:
Author:
Publisher: Self-Published
Year of Publication:
Place of Publication:
Pages:
Price:
Subject:
Language:
Paperback or Hardback:
Your address for communication

You also need to enclose the following:

Photocopy of the cover page
Identification Proof
A self addressed envelop for return communication

Important Points:

Price: It is better if you put your price higher than that on Pothi.com (a mark-up of 40-60%). The reason being that when sold through other channels, the prices would usually have to be high to accommodate the margins for intermediaries.
Hardback/Paperback: If a book is published in hardback as well as paperback, two different ISBNs need to be taken for the same. So, be clear about which version you want the ISBN for.

The application should be sent to the following (updated) address:

Raja Rammohun Roy National Agency for ISBN
West Block-I, Wing-6, 2nd Floor,
Sector -I, R.K. Puram,
New Delhi-110066
Phone: +91-11-26172903/26172916......."

IS BOTH ARE SYNONYMOUS ?
OR BOTH ARE MANDATORY ?
IS ISBN No ALONE IS SUFFICIENT ?

PLS EXPLAIN ?

THANKING YOU ALL !

Ownership of the source code of customized software

Respected Sir,

We own a small firm. Two years back, we hired a programmer to develop a customized software for us. We offered our man-power to help him build our software that assisted him in developing this software for 2 years.

The programmer was, however, very difficult to work with. After completing about 75% of the work, he received the full payment from us. After sometime, some disputes arose with him due to his difficult behaviour after which he took the source code of our software and left.

He is not willing to work for us anymore. And we do not want to bring him back to complete our work either. The software is left incomplete at 75% and we want to have the rest of the work completed by some other programmer. For that, we need the source code of our customized software which he took with him when he left.

We demanded the source code from him but he refuses to give it to us. Without the source code we will have to start our work from the beginning again and that will waste a lot of out time and man-power.

So my question is:

(1) Do we have the legal rights to demand the source code of our customized software under these circumstances?

(2) Is there any law in India (equivalent to intellectual Property laws in other countries) that states the ownership of the source code of this customized software?

Thank you for giving your valuable time.

Sincerely,
Shweta Nandini

Gold kept at pawn broker

Dear Sir,

Due to our family financial crises we have deposited our Gold Ornaments at one Gold Business man(Pawn broker) in Guntur of Andhra Pradesh in the year of 2005. He was written the gold details in a empty card and given to us. Expect gold measurement details nothing was mentioned in the card including Pawn broken name also (not mentioned in the card). But he was maintained one register which is serially numbered and the cards also having the serial which will be match to the register.

Now in the year of 2012 we went to the Pawn Broker and we have asked to release our ornaments. But he refused to give the articles since the time was crossed one year. He is telling that we was sold the ornaments.

I am requesting you to help me out how can i get the ornaments back. The ornaments are very sentiment for me.

Regards

Praveen

Urgent query on ipr

Dear All,

We are manufacturers of Capital Goods ( Machines). We are about to eneterd in to Sale Purchase Contract with one of our customer.

Customer has put obligation on us relating to Transfer of Intellactual Property in Machine.

I believe that mere sale of machine does not give any right to customer to own Intellactual property rights of the Machine. However, he can surely put obligation for transfer of clear title in machine.

kindly clarify this issue, Does sale of Machine amounts to transfer of Intellactual Property Rights in the same???

Regards,
Gargi
