Dear Sir,
Our property is in the name of my grand mother & now she is no more. She have 3 son & 2 daugheters out of whom 1 elder son is also no more.
Now the issue is that our grand mother didn't made the partition neither she had her will that this property will be distributed between 3 sons. So no distibution is there.Also we are not having NOC from 2 sisters but one sister is saying that they will not claim her portion.
Plz guide us how we can resolve the partition issue as 2 brothers out of three is also not showing interest in partition as there intension is malafied.
Is there any provision where we can claim our right with the help of Govt.

We are about to purchase a software for our accounts department. The vendor is having intellectual property on his product. Can we use the same product for other department without paying him any additional amount towards IPR. Pleas give your suggestions with regard to IPR on software products.

There are 2 queries
1.Suppose I m using xyzshow from year 2007 and booked a domain xyzshow.com but in the year 2008 some other company booked xyxshows.com ....this is confusing the customers...i applied for trademark xyzhow few months back....can i sue xyzshows.com?...is there any way i can stop xyzshows to discontinue their operations?
2. is booking a domain can be shown as 'user' thing.....what documents are needed to show the usage of the mark?

I applied for trademark of my co. name 3 months back....in website its still showing as new application...what is the further process?...do i have any advantage of applying earlier if somebody applies with similar name now?...will be grateful if somebody can help

Respected Experts,
Before some days, I read a Bengali novel in eBook (pdf) format. It was a good story.
Presently I saw an website is posting the story in their forum in story section. They did not changed the name of story or the writer. They changed some portion of the story.
The mentioned forum is "Adults story forum" and they are inserting Porno Dialects and sexual scene description that was not in the original story. the forum is xbii.com. This site is very popular among the Bengali porno readers, so the writer is marked as "porno writer" among those gentlemen.
The real author was publishing his story part by part in an e-magazine. As the result of the above incident, he just stopped the story and do not want to write again.
Please suggest how to stop these nuisances?

Last month my younger brother died in an accident. Some facts are here about him:
1. he was 29 years old, borned in 24feb'1981.
2. he was married last year in 15feb'2009
3. was currently working in an MNC, Gurgaon.
4. was away from his family since last 13 years for his study, career and job.
5. his wife is also working in an MNC, Noida before her marriage.
6. he has no kid.
7. his wife is not staying with us, after his death.
8. he left his parents, elder brother(married) and elder sister(married) behind him.
9. his father(65 yrs old) has no business since last 12 years after some family disputes, has only some rental income. And mother(58 yrs old) is house wife.
10. his elder brother(myself) is married, 31 yrs old, having a kid and working in a medium IT firm Noida.
11. he purchased a car and a laptop before his marriage.
12. has taken insurance policy of TATA-AIG, mother is nominee.
I have mentioned all things regarding him, so that may get better suggestions by you all.
now after his death, his parents-in-law is claiming for everything regarding him, like his car, all claim amount and gold.
Just want to know, what's the legal rights of his family and his wife in our case?
