Is court order required in case a person goes missing and not traced even after 7 years

Dear Sir,
My mother,then aged 78, went missing in Sept.98 and could not be traed after seven years. A compliant with the area P.S. was given and also a copy of which was given to MPS, Darya Ganj, Delhi. She could not be traed till today and after expirty of 7 years, concerned P.S. gave in writing that a person could not be traced.
We tried to obtain a court order on this issue but the Tis Hazari Courts did not issue any order after so many years, that there is a ruling in Indian Evidence Act, 1872, Section 108. Kindly advice if there is any judgment where exemption is granted to take an order from a court and settle issues with any entity.

Builder sent notice for payment

I have booked property 3 months ago its ready position new flat and done agreement registered I have done yet the payment of one lack by check and put the file for loan but now builder sent me letter that I have to pay the bal amount in 15 days with the interest of 1 lack the bal amount is 23 lack now what I can do please help im not in the position to pay im helpless the bank is saying 1 more month and builder did not said anything about interest at the time of booking that if loan from bank takes time now suddenly I have got this letter is this is legal cause the property was ready position at the time of booking is there no law for the person who is going to take loan he will not get time for loan approvals please help

Regarding issue of a legal notice.

Dear Experts,

Would like to know if a common man can send a legal notice to a person who has not performed his part of the contract.

We had bought furniture from a manufacturer and it turned out to be defective. Even after persistent follow up he has not showed up. He charged us a bomb for the furniture he made which broke in 2 months from the date of purchase.

Can we, on our own write a legal notice and send it to him via registered ad for deficiency of service and cheating and if he does not respond then file a case against him at the district consumer forum or only a lawyer can send a lagal notice?

I got divorced under section 13(b) of Hindu marriage act 1955 in 2008 at district court Chandigarh.is it possible to get the judgement modified as anything related to custody of the child is not written in the judgement made by the judge

Reg.. fd withdrawls of my late father

my father is having FD'S with KVB,LVB&SBH at hyderabad.iam carring 1)DEATH CERTIFICATE,2) FAMILY MEMBER CERTIFICATE( issued by THASHILDAR).with these documents LVB had cleared but KVB& SBH are probing to get SUCCESSION LETTER. when LVB had cleared why cant others do the same?
can you help me legally?

Selling of property

If a property is being allotted by the govt public bodies to a person on reserved commercial rate for a particualr business purpose, and gifted to his son for using it, while the business was given to another son, the mutation of the Land on behalf of the WILL was done by the Govt bodies, can this Land be sold to the third person in need of money?

I want to change my current surname to my real family name

Hello sir,

I want to change my current surname to my real family name, I have read all the procedure in order to get my surname change through gazette But there is a Dilemma in me Do it or not.

Reason is As of now I am working for an Software company from last 5 Years and all my documents is with the same surname. Except Passport as i have not applied for it yet.

Before applying for it , I want to change my current surname to my real family name.

Below are my some questions on it, It would be a great help and thankful of you if you advise me on the same.

1. Is it possible to change my surname at this stage ?

2. If changed, Can I apply for passport with changed surname ? Will there be any problem in applying for passport if my old documents are with oldname ??

3. Is there any condition to change my all documents with new surname then apply for passport ??

4. Is it possible to change surname on old documents ??.

is rubber stamp signature valid on cheque and bank documents

Hi,

I am a software engineer. As I am not able to put signature's which is matching can I use rubber stamp for this purpose??. Every time when I sign on multiple places like bank documents my signatures are not matching each other. So having issue in day to day activities. Can someone suggest if signature rubber stamp is legal on bank documents and cheque.

Passport documents required after intercaste marriage

Hello sir, I m married since 8 yrs. Done intercaste marriage n change my religion from Muslim to hindu. Currently I have applied for passport n all the required documents have been attached. But the officer at the rpo said that the religion change certificate has to be submitted because of freedom of religion act 2003 n it requires collector office registration . Request ur advise as I m in urgent need of passport. I have submitted pressnote, name change certificate from gazette, affidavit for name change n others. Also my husband has my changed name in his passport.

Power of attorney

Respected all,

My friend father has signed a Notary Document titled as "Power of Attorney" and the same has handover to third party of land dispute settler for the settlement of their land from others. This matter no other family member known. In the document it has mentioned that if the land settlement done by the third party, they will be entitled for half of the share of their entire property. Actually the property they acquired from their forefathers. Now the question is the document is valid without any registration and without having their other family members consent. The third party person took his father to Notary Advocate and given his consent. Kindly clarify,
