Shop advance problem

Hello sir I have taken a shop for rent & I have him 3lac advance for shop I have Rund the shop for 2 to 4 month & I have not received profit from my shop so I have decide to left the shop
And I have left the shop the shop own told me to Return the it take 2 months time but I have hem 3 months time now he is not giving my money back sir

Macp in case of criminal case.

Good evening sir/madam,

I am a government servant and My MACP is due since Jan 2023. All my APARS are very good. Had never any history of departmental proceedings or so.

I am facing no departmental enquiry or charges, however I have been named in an FIR related to dowry demand, though there happens to be no marriage. I had informed my deptt. related to this case.

I have never been arrested or there has been no charge framing in this case since last 5 years. The matter is subjuidice.

My question is can my MACP and pension benefits(I am due to retire next year ie. 2024) can be withheld due to this false criminal case?

Nomination and power of attorney

I and my wife have joint savings account and demat account for shares with a bank. We have given the name of our son as nominee. As we are very old and may not be able to operate bank accounts etc. we have executed a general power of attorney in favour of our son. Now an officer in the bank says that a nominee cannot be a holder of POA also at the same time. We have given the name of our son as nominee because in the event of our death transfer of our accounts to his name will be smooth and fast. He is our legal heir also. One can give power of attorney only to a person in whom one has full confidence. There is no one else to whom we can give POA. What the bank officer says appears to me illogical causes difficulties for us. I want to know whether there is a law of the land that confirms what the bank officer says.

Regular bail in sections 8 & 12 of the pocso act, 2012

Respected Sir/Madam,
I have been falsely implicated in a counter blast FIR U/s 8 & 12 of the POCSO Act, 2012 in the state of Jharkhand. Till date I am any how managing to evade arrest.

My Anticipatory Bail Petitions have been rejected by the Hon'ble Sessions Court, the Hon'ble High Court and unfortunately even by the Hon'ble Supreme Court. A Non Bailable Warrant has been issued against me.

I have not filed Quashing Petition U/s 482 of Cr.P.C. before the Hon'ble High Court yet which, I consider was desirable before approaching the Apex Court for Anticipatory Bail.

In above mentioned conditions, how many days tentatively I have to remain in Custody IF I SURRENDER BEFORE THE COURT AND PRAY FOR REGULAR BAIL.

And, also be kind enough to guide that whether a Quashing Petition will be tenable before the Hon'ble High Court?

I shall remain grateful to you always.

Demand for additional maintenance from the builder

I took possession of a flat in a township in Pune in 2018 after paying all the dues including advance maintenance as demanded by the builder.Before taking possession I was given a No Dues pending letter from the builder.After 2 years the society was formed.After this the builder started demanding Additional maintenance for the 2 years and started sending legal notices in his letterhead threatening legal action against us.My question is has the builder got a right to demand such additional maintenace after giving No Dues pending letter and after paying in advance 2 years maintenance? What are the remedies for us if he proceeds with legal action?

Grandson share on motherway ancestral property

Dear Sir,
Can I claim my share in motherway ancestral property when my mother is alive but she is not ready claim equal share from her brothers.
Can I file the suit to get equal share to my mother when she does not want equal share on ancestral property.
What should I do to get equal share to my mother or me from the ascentral property even my mother not intrested to claim.

Wife may file 498a case

Dear sir,
4 years back I got married. Now we have two children(girls). After one year of my marriage, disputes arose in between us. Since our marriage my wife is under influence of her mother. Now I am suspecting that my wife may file a 498a case against me. can I take any steps even before she filed a report, to protect myself. Please help me.

Cyber crime hacking of acount

my wife and i have sb accounts with two seperate banks in mumbai.
in the month of february 2003, our accounts were hacked and rs. 300000/- was siphoned off. two lakhs from my wife's account and one lakh from my account.
the crime was reported to both banks the very next day. a fir was also filed with cyber cell of mumbai police. the banks refused to entertain our claims to refund the money on the arguement that they have followed the due procedure. after disputing for a long time i filed a complaint with banking ombudsman by sending copies of the copies of complaint made to banks and a copy of fir.
the ombudsman was kind enough to finally give its orders to my banker to refund rs.91000/- which the banker did promptly.
however, the ombudsman based on the submission made by the bank and without hearing me, passed orders that the bank has taken due care in the operations in my wife's account, and the bank is not liable to refun d the money and closed the case. the ombudsman was kind enoungh to state that their orders was non-appealable. they also advised me that i can move against the order in appeal with any consumer forum or any other legal recourse. I am a at a loss of rs. two lakhs.. since the banking ombudsman closed the case, the bank says they will not be able to help me in the matter.
two pints to be considered : the operations in the accounts were similar. but one account got a refund and the other did not any refund. in fact, i may state, my wife's banker did not follow the guidelines issued by rbi.
my request, therefore, is whether i can approch any consumer forum or have any other legal remedies.
I would appredciate an early reply.

Sale of property.

Two years ago my father died intestate. We are three sons to him and my mother is now 70 years old and the entire property is with my father's name. (My father got the property by way of a partition deed, in 2000)Due to some reasons, we all wanted to sell 2 acres of land even before entering into a partition deed. When property is not in our names, is it possible to sell the land? Will the sub-registrar accept to register it in the name of the purchaser? What is the legal position?
