Breach of trust

Sirs,

Since last 14 years, a person worked as a mentor in a registered school, created some false and fabricated disputes with institute and left the school. He misguide the old school parents about school management and induced them to apply for L.C. from old school and assured them that within fifteen days he declared to open a new school in mid session itself. Maximum parents applied for L. C. and left old school. He done so far as he said to the old school parents. school management now came to know that six months back a new foundation/Trust registered in the name of his wife, wherein his wife and himself are the trustees. The name of said trust/foundation as well as the new school is quite similar with the name of old school.

Can a trust take legal actions against said mentor? under which provision?

Can the said institute file a criminal complaint against said mentor for criminal breach of trust or other?

A defamation case under section 499/500 with 420 IPC can be brought against such person with complaint to Department of Education of that State which has given recognition to similar name to withdraw permission thereto.
