Bail

Querist : Anonymous (Querist) 01 March 2011 This query is : Resolved 
Respected experts,

It happened that two accused was arrested on Thursday evening and on Friday morning(10 a.m)both was produced before First Class Judicial Magistrate, subsequently both was remanded to 3 days police custody.

Again on the same day(Friday) afternoon bail petition for bail of both accused was moved before court of Chief Judicial Magistrate of District and accordingly he endorsed the bail petition to another First Class Judicial Magistrate then this magistrate allowed the bail of both accused and accordingly both accused was released on bail in evening on same day(Friday).

My query:

is this allow in law??

any others comments/advice on above fact??

pls give details of the section in which they were arrested without thaw no body can advice u any thingh as far as the matter of bail is concerened that is the discretionary power of the court.

Detained persons have the right to move for bail. Magistrate also have power to give bail for the above offense.
