Appeal

(Querist) 18 January 2011 This query is : Resolved 
we have filed I.A in a Civil Suit for striking of our directors name from array of parties in the suit. the same was dismissed by the lower court. can i file an appeal against the order or i have to file a revision.

Order is not revisable nor appeal can be filed, you have to approach high court under Article 227 of Constitution

The order is not appealable. Neither section 104 nor Order 43, Rule 1 of the Code of Civil Procedure, 1908 include such an order in appealable orders. You can file a revision before the High Court under Article 227 of the Constitution of India.
