annulment of marriage

Querist : Anonymous (Querist) 30 October 2010 This query is : Resolved
mr.barman, actually i am the one who has asked for annulment and now my wife is accepting the same but without allegations .can the judge give the decree? If so, i will have no hold on her to take back the 498A case.how should i handle the situation.
Devajyoti Barman (Expert) 30 October 2010
Yes on her admission the judge can give decree. But I fail to understand how you could be able to have hold in the 498a case if you would have got the decree on on your own. The granting of decree the matrimonial case has no bearing on 498a case .

Yes, action under Section 498A has nothing to do with decree of divorce.
