Alimony

My father has not been paying alimony even after court order. My parents got divorced in 1992. They were married for 8 years. We filed a case a few years back. But unfortunately we did not find a good lawyer. I am a student and my mom is a home-maker. We ahve no osurce of Income. Please guide us.

Firstly you send a letter to your father asking to obey the court order. After a period of one month you can consult a lawyer and file a case of contempt of court. Since your case had been decided already in court the lawyer may not charge you initially as court may grant the cost of filing the case.Try.

You can consult a lawyer, disclose everything to him including your financial status. Specificaly tell him that you cant pay any such charges till you get the dues from your father as ordered by court.He will help you in filing the execution petition to realise the dues out of which you can pay the fees as fixed by your lawyer.

Without knowing the present status of the case it s difficult to advise.

If the order s passed in the proceeding u/s 125 then warrant of arrest could be issued against him to enforce the order.

However , do not fail to note that the son after 18 years is not entitled to maintenance whereas daughter after her marriage.
