Agriculture land at maharashtra

(Querist) 09 May 2014 This query is : Resolved
My grandpa having land at Maharashtra. He was having 2 daughter and 3 son.all got married. one daughter after marriage, died. but she is having children. and other daughter(my mom) is staying with us in other state.

My grandppa died long back.
All 3 son divided the land among themselves without any information to others.

Some villagers/neighbors informed us that the 3 son has divided land between them is not registered. and they have to give equal portion to both daughter also.

The daughter is having right to claim the portion in that property?

Please suggest for same.

Your mother has a share in the ancestral property of your grandfather and she can seek partition.
If it is self-acquired and your grandfather (nana ji) died intestat then also she (your mother) has a share, file a suit.
Engage a local lawyer

Yes daughters have right in the property of father.
T. Kalaiselvan, Advocate (Expert) 10 May 2014
If the property was self acquired property and there no settlement or family arrangement or partition or Will left by your grand father and he died intestate, the entire property will be shared equally among all his legal heirs, since your mother has a right to her legitimate share in the property, she may file a partition suit seeking her share in the property, this will solve the issues.
