what is this original agreement? Don't you have original regd., sale deed of the property?
Ganesh Chavan (Expert) 13 October 2011
Sub-Registrar office is not insisting on filing complaint/FIR for lost or misplaced documents while requesting for duplicate copy there fore file a Application for the duplicate copy of the Agreement to the Sub-Registrar office.

:::ANSWER:::
YOU MAY AND SHOULD APPREHEND ITS MISUSE BY THE FOUNDER.SOME ONE MAY BY IMPERSONATION MISS UTILIZE IT AS EQUITABLE MORTGAGE AGAINST A LOAN BY ITS DEPOSIT WITH THE CREDITOR AS COLLATERAL SECURITY.

LOSS SHOULD BE REPORTED TO POLICE AND PUBLICATION OF LOSS SHOULD ALSO BE MADE IN LOCAL AND NATIONAL DAILY WITH DUE DETAILS OF DEED AND SOME TOKEN MONEY SHOULD BE OFFERED TO FINDER ON ITS HAND OVER TO YOU ON ADDRESSED PUBLISHED.

What is the contents of agreement?
Raj Kumar Makkad (Expert) 13 October 2011
Prabhakar Singh ji! Please make me correct if I am wrong. In my view, NONE CAN IMPERSONATE OR MIS-UTILIZE AN AGREEMENT AS EQUITABLE MORTGAGE AGAINST A LOAN BY ITS DEPOSIT WITH THE CREDITOR AS COLLATERAL SECURITY.

The querist is enjoying all of we experts who are replying in darkness without having true knowledge of the lost document.

Mr. Querist! Please reappear again and break the suspense over your agreement. What is this agreement dear?

Of this is an agreement to sale and if it was not got registered with registrar, you are very big loser. No one becomes owner of any immovable property on the basis of agreement only. First disclose about your agreement then I shall tel you detailed information. Meanwhile file a police complaint about loss of document.
prabhakar singh (Expert) 14 October 2011
MR. MAKKAD YOU ARE CORRECT IN SAYING AN AGREEMENT TO SALE CAN NOT BE MIS UTILIZED BUT A SALE DEED CAN BE AND MY ANSWER WAS UNDER GUESS OF LOSS OF AN ORIGINAL SALE DEED.
