Admission of appeal before district court.

(Querist) 27 January 2014 This query is : Resolved
Resp. Members,
I have filed a civil appeal in Pune District Court. It has been filed and registered and Court has been allotted to this appeal. Now what will be the stages till end? What is the stage of admission of appeal? What are the chances of getting it dismissed before issuing notices to the other side? Please advise.
Devajyoti Barman (Expert) 27 January 2014
Once appeal is admitted the appellate court would call for the lower court record and hear the appeal if the respondent appears in the case.
Without knowing the case details how could someone say about merit of this appeal.

I agree with Expert Mr. Barman. Going by what you have stated a Court had already been alloted;your case is admitted an the normal proceedre of issue of notice can not be stopped at this stage or no other court can interfere.
However during pendency of disposal of the appeal the respondant can move High Court under Article 227 to stay the district court proceedings that too only if high court feels its interferance is justified.

I agree with the opinion of Mr. Thyagarajan on the subject. Further until knowing anything about the case, it is not possible to opine about its maintainability.

From what three of us had said you can see your case is all set for normal course of appeal. Wait for counter from opposite party
Advocate. Arunagiri (Expert) 28 January 2014
Normally the appeal will not be disposed without hearing the other side.
