Accident case conviction and jail

Querist : Anonymous (Querist) 08 September 2023 This query is : Resolved
what will happen if criminal appeal against IPC 338 is dismissed. Does the accused sent to jail immediately or will he get sometime to go to high court.
Quick Summary
If a criminal appeal against an IPC 338 conviction is dismissed, the accused may be sent to jail. However, they can file applications to suspend the sentence and stay the trial court's judgment while pursuing further legal avenues. While generally one appeal is allowed, there's no automatic right to a second appeal, unlike in civil cases. Jail terms are rarely imposed for Section 338 convictions.

The accused can file a suspension of sentence application and and application to stay operation of the trial court judgment o the basis of the appeal.
In the generality of cases of convictions by magistrates of the first class and sessions judges, a single appeal is provided, except in petty cases and from certain summary convictions. Unlike in civil cases, there is no right of second appeal.
