Tikona case

Guest (Querist) 23 January 2017 This query is : Resolved
Dear all,
I had used Tikona broadband connection during January 2016 and disconnected at April 2016 due to reason of shifting home from Chennai to Madurai. During that time I talked with customer care people for collecting modem. He said the installation charges inclusive of modem so you can take with you. So during shifting I have taken with me. During may 2016 one collection agent called me and asked for modem. I said the reply said by customer care. And further added if you need pls say I will return you by coming Chennai but He also did not call back and I got a mail as final bill payable is 0INR. After that I got call from Tikona enquiring reason for disconnection alone and no call regarding modem returning.
Now on 7 January 2017 I got a call from a un know number saying name as Nirmala advocate I am going to file case in Delhi high court for not paying bill.
I called a guy who came during installation and explained the same. He said ok sir just mail customer care to arrange for collection agent to collect modem. Your problem will be solved. I too mailed them with my user id. But they replied to pay 988 INR and penalty 1500 for not returning modem. But I mailed them to arrange a collection agent to collect modem once he call me I will come personally to Chennai and return modem.
Kindly clarify following
1. Can they file case against me if so what case
2. I am ready to return modem but they do not care about that then how can they file case
3. Previously they only said final bill payable as 0 and after that I did not use connection now why they ask to pay 988 + 1500 if not case would be filled. How come this possible

Thanks and Regards

Such calls are made by recovery agents employed by company who have no legal authority. Rest assure if company files any suit it will be at channai and may be settled in lok adalat easily. You dont need services of any advocate for that.

Agreed with Mr. rajeev sharma,

Record all calls.

Tell the callers that you have already communicated with M/s Tikona direct and agents may get in touch with company for desired correction in the records and that you will handover the matter to your own counsel and may write to TRAI,DoT also and complain.

Transact in writing direct with company.
You already have bill showing 0 outstanding.

Do you have copy of SEF (form used to apply for connection) and T&C sent along with issue of connection, installation, and receipt of payment made by you for installation?

One should keep all such documents safely.
You need to explain that the installation charges were said to be inclusive of cost of Modem on dated:………………..(mention phone numbers/date/time if you have) when you informed disconnection and narrate other discussion later and remind that it is their lapse, and you have NO liability to pay, and hence M/s Tikona should cancel their last BILL showing NO outstanding, and supply to you in writing detail/address of their local office at your current location that will collect Modem.

Let them supply you: copy of SEF, T&C, receipt etc and final bill showing NO outstanding.

Thereafter if the Modem is not your property, handover at your current location under proper acknowledgment.

Normally the Agents are capable of such things backed by the Company and Company People would coolly state Agents had done it. .As far as you have not issued any cheque which had bounced you are Fine.Even if you receive any Summon from out station you need not attend and it should be only a civil case. Before settlement take an Undertaking in writing that there will not be further calls or disturbances from them or Collection Agents.Meet the Higher Officials of the Company and be firm and collect said letter before any settlement.

further an Advocate who functions as Collection Agent Or Recovery or Job in any Other Category should not Practice in Courts.Next time if you receive any Calls from such persons claiming to be Advocate ask their Bar Council Enrollment number and full name and tell that you are going to file a complaint in Bar Council. If they are genuine Advocate they would disconnect and if they are Bogus they will be arguing with you. From which you could Understand.

You are welcome.

You may write under proper acknowledgment.

Until the Bill is called back the recovery agents may not stop calling you.

Dear All,

I have sent following mail to the appellate authority.

Dear Appellate Authority,

My user id is 1116382507, registered in the name of R. Pradeep Annamalai. I got connection at Chennai during January end of 2016. I have disconnected your service during April staring of 2016 due to the reason of shifting home from Chennai to Madurai. During March end of 2016 I talked with your customer executive about this and asked to arrange a collection agent to collect modem. He said “The installation charges you paid is for that modem only you can take with you we won’t ask it back.” In that telephonic conversation. So, during vacating I have taken modem with me.

After a month during May 2016 I got a phone call from one the collection agent asking for modem. I said the words said by customer executive and added even further if you need modem call me back I will come to Chennai and give you at your office. After that I did not get any calls regarding that and got a mail as Final Bill Payable as 0 INR. I got call from Tikona asking reason for disconnection two time but no one asked for that modem. So I also did not care after that.

During 7th January 2017 I got a call from a number 9873924068 named her as Nirmala , Advocate of Delhi High court and said Tikona has filled case for not returning modem. So I called the guy Mr. Murugan who came during installation and explained the things happened. He said no problem sir, just mail to customer care to arrange for a collection agent and return the modem when he calls. So based on that I have mailed to arrange for collection agent and ask him to call me to my registered mobile number 8903576315. Once he calls I will come to Chennai and give to him within 1 or 2 weeks and also kindly instruct him to give me acknowledgment for that. Online request number for that mail is 1-4534599521

But I got a reply as Amount Payable 988.66 INR. How come it possible without using connection. So, I again sent mail to arrange for collection agent & I am ready to give the modem, when he calls I will come to Chennai and give the modem. Regarding this I called your toll free number 186030003434 on 25th January 2017 and spoke with customer executive named Nazrin. She said we don’t want that modem you pay amount and keep the modem with you. Then she also added that do you want us to mail monthly to get the modem. How can she say like that even after explaining the matter and when I am ready to return the modem. And toll free number charged me 40 INR for that call.

So, I have approached you. Kindly arrange collection agent for this matter or send me the address of Chennai office I go personally and give that modem to solve this matter. I believe you that problem will be solved by you.

This way of speech is harassing me. When I am ready to give modem if you deny then I can approach Consumer court for harassing me and giving threatening calls.

Thanks & Regards,
Pradeep Annamalai R
