239 discharge in lower court

Hi friends,

Please clarify what could be used as grounds for discharging 498a case running in lower court using crpc 239.

Charge framing is not yet done.

Till when I can do the above.

it is necessary to go through the allegations made in complaint lodged . without going through the allegations we cannot suggest grounds for discharge

It is not the right time to go with Section 239 Cr.P.C. as Section 173 Cr.P.C. should be complied with first.
