After death of my father, my brother has filed a declaration suit in civil court by producing the will of our father. He has not gone for probate. Is the civil court has power to process the case.

You provide the details of the case of your brother. As per my presumption, it shall be for getting probate of the will. Obtain its details and post herein so that accurate reply can be made.
