Querist : Anonymous (Querist) 23 January 2011 This query is : Resolved
if someone is in govt job and dies before retirement .he does not nominate anybody as successor.his wife is away from him for more than 17 years and several cases run between them and his son also was away from him since birth and were send maintenance exp. now aftr the death he leaves behind a widow mother, a sister which did not marry for the sake of her brother and a widow sister who were dependent on him.

now my question is how will his property that is pf fund, gratuatity etc will be distributed
Arvind Singh Chauhan (Expert) 23 January 2011
It depends on several factors as-
1-Name of wife in service record.
2-What formalities department is asking for the payment, succession certificate etc.
3- what is the legal status of second widow.

The inheritance is based on the available documents
adv. rajeev ( rajoo ) (Expert) 23 January 2011
Class I legal heirs of the deceased are wife, chidlren and mother.
Sisters are not the class I legal heirs. widow sister is the legal heir of her deceased husband.

Mr. raju view is correct. It is better for that person he should widhraw maximum benifits and ask a loan from department, execute a will about other property and left some blank cheque for his sister and mother.

I agree with rajeev.
