when resiganation comes into effect

hi
when there is no contract & the post of officer is high rank which is not under the wages act & industry law...
the officer resign VOLUNTARILY...
1. does it comes into Effect immediate?
2. does it needs ONE MONTH NOTICE?
3. or to waive such notice he has to pay one month salary?

as there are many case laws regarding the Voluntery Resiganation:
when there is absense of any provision regarding the resiganation then it comes into effect immediate

If you have the information that the resignation comes in to effect immediately, the reason for calling opinion of experts is not understood?
Mind it, try to leave the organization without orders of the competent authority on acceptance of the resignation and handing over of the charge to the appointed substitute then experience the result of being a deserter, having absented without permission and urther to face with a disciplinary action instead of honourable parting of the ways with the organization..
