Dear Anonymous,
Your query is quite vague, kindly ask specific pointed question based on the factual matrix of your case.

Best Regards

Yes your querry is very general and vague still if you contest properly you can not be evicted.

In such cases initial mistakes are fatal so take proper care and take expert legal aid.

sir actually the premises caught fire in 1999 after that he was not allowing me to carry out repairs so i got a permission from the pune muncipal corporation for the same. after this he registered a case which went in his favor at the small causes court in 2005 . after this i registered a case at the district and sessions court. the case is still on . what my question was that can i get any help under the rent control act 1999. i am occupying the premises since 1987 and this premises is the only one from where i earn my bread and butter. so i cant vacate it also i was ready to purchase it or to increase the rent and continue but he is in no mood of settlement. he just says that i should leave. i have a goodwill at that place which cannot be continued at another place.so plz help

Do you have proof that fire damaged your house?Do you have proof that you asked for repair and he refused?I presume that it would not be merely repair but it could be permanent construction because for repairing house you need no permission from the Mun.Since you have made permanent construction without permission from the landlord, you could be evicted. However since you have made it inhabitable which was the duty of the landlord, your advocate has to try hard to take you out.

it wasnt a permanant construction. the top floor of the property was damaged and needed repairs like wiring painting and as the floor is made of wood some wooden repairs. i have the letters which i had sent to the landlord and there is a record in the muncipal corporation about the fire which broke out at the premises also a record with the fire brigade .
