Hi All
Need your expert advice on employees working as a contract staff thru contractor during their weekly off... ( Company is ok for it)
What kind of leagal implications we have in this case ???
Company will be remitting all the statutory contributions for the days he worked as employee..
The days he is working thru contractor will not effect his leaves ...
contractor will pay all the statutory contributions for the days temp force worked...
What kind of liabilities CLRA & SE Act in this context???

The liability as same as employees are under principal employer. The employees are entitled for overtime wages as per factory Act or Shop and Commercial Act, whichever is applicable.

Agreed... What my question is if we hire a contract / temp staff, we will pay the money to contractor and he will pay to the temp resource...
company will pay min wage, all st contributions and service charges to contractor..
Question is the guy who is working as temp is already employed in the same organisation and for that day he will be coming as temp staff.. they agreed for that..
Is it legally valid ???
