Sr Members,

i would like to file a Writ petition for jurisdictions for divorce and maintenance suits.

The otherside advocate filed both the suits in wrong jurisdictions
[@ parental place of the complainant].

Both suits got exparte.

But after decree, can we file for jurisdiction and whats the time limit.

Pls enlighten me.

You can file application seeking setting aside ex-parte proceeding in the same court o r may file a writ before HC raising even the question of territorial jurisdiction of lower court passing decree under challenge.

thank you,

1)i doesnt want to challenge the decrees, i want only to fight only about the territorial jurisdiction

2)time limit for the same.

please advise on above 2 paras
