Third party insurance claim

Dear learned experts

On 13th Feb, owner of the car along with his wife two kids and his brother in law were travelling in midnight from bangalore, owner hit the standing tanker without noticing..his brother in law died in the hospital after one hour of admission. Owner, wife and two kids are out of danger. Vehicle is insured.can his�brother in law's wife claim 3rd party insurance. Please guide. The one who died is my sister's husband.

Yes, she ca claim compensation and she needs to file a complaint in MACT.
