Summon

Querist : Anonymous (Querist) 27 February 2010 This query is : Resolved
Actually my wife has filed 13(1) case for divorce HMA.
It was as per my and my wife's predecided settlement in lieu of lumpsum alumni.
But i have not received summons in this regard.
The date to file W.S.A. is given to us privately by girlside only by phone and a copy of the filed petition also given by herside privately.
If without summon ,I file W.S.A. the will further proceedings will be valid or not?
Is there any chance of cheating with me?

If you also wants divorce and settlement has been arrived honestly between the parties. You should receive the summon and should not attend the court on the fixed date, and let the divorce be decided exparte.

Attend the court on the date and see the counsellor and state the facts and ur consent for divorce. If u have paid her all money then it is advisable to attend the court otherwise she may withdraw her petition.
If u have not paid her then follow Expert Arvind's advice.

You may appear and file Written Statement even without receipt of summons from the Court if you have knowledge about the pendency of the petition and its date of hearing. The further proceedings will be valid. In case you apprehend any cheating on the part of your wife, you may verify from the court about the assertions made by your wife to you.
