Student disable to wirte in exam.

(Querist) 13 July 2011 This query is : Resolved
One girl is not able to write in exam due to disease named "writer's cramp", she approached to the "Institute of Company Secretaries of India" but no relief is provided yet. will she lost the dream which she imagined at the time of joining the profession she passed executive program (inter)and now in professional program (final)but a long time passed she couldn't appeared in exam due to her hand problem & one the one side medical practitioner's had said this is the problem of "writer's cramp" and they are not sure about treatment on the other hand they refused to provide the "permanent disability certificate" but provided medical certificate for temporary period but the Institute refused the medical certificate and demanding for "permanent disability certificate". Now she has demoralized.
She can be Company Secretary if one writer / type writer is provided to her for exam.
Will she be a qualified Company Secretary? This is a question for her because of this problem.
Many student losses their dream due to such problems.
There should be a provision for such situations in laws & rules of educational & professional institutes.
Are you agree with me? Am I right? should there be a remedy for such problems? Is there any right for such students to get the professional education ?

Generally every institute having some rules and regulation .
Some rules provides up-to certain extent give permission about the disability.
You have to check the rules and regulation set-out by "Institute of Company Secretaries of India"

For that go to www.icsi.edu/
And carefully read the rules ,if having doubts then go to any local cs institute for help.

Dear Experts,

This is a question of future of all such students who are unable to write in exam due to their physical disability instead of good knowledge and potential to carry on the profession.

If the educational Institutes / Universities / Board do not contain the rules for “writer / typewriter” for exams then their rules should be amended for advancement of such students.

In the absence of any such rules there is a hopeless future for such students.
That’s why there must be such rules in the law of educational Institutes for such student to make their future bright.

Dear Mr. Raju,
Please do not paint a very bleak picture. Did you try any of the suggestions given here and if so with what results. Without attempting anything, please do not jump to conclusions.

I already asked about this to the Director of Student Services of Institute of Company Secretaries of India,he said there is no such rules in Company Secretaries Act, 1980, then what to do else?

In another thread where you had posted the query, I had suggested to you to first get the medical certificate and approach the ICSI institute. Did you do that?

I had also stated that in case in spite of medical certificate the Institute does not permit another helping hand, then approach the High Court through a writ petition. did you do that?

All things will not be available in a platter. In a democracy, it is for us to demand and get it. Yes, it will take time and effort. There is no other go. But one cannot say that the future for all such affected people are bleak.

We approached to the ICSI alongwith the medical certificate issued by doctors of AIIMs and requested to the Director of Student Services and principal of Examination but they denied by saying that their rules doesn't contain the provision for this.We also sent the request letter alongwith copy of medical certificate and other papers, but all in vain.

What about filing the writ petition in the High Court?
