Someone placed an injection against our property

(Querist) 06 May 2018 This query is : Resolved
1970s we had a business land, which we sold a person,

Later he has sold it third person and then to forth person.

In 1998 we bought the same property from that 4th person.

Now in 2018, we received a court notice, stating they have some document showing our property under mortgage in 1977...

Could Someone please

What is the best way to solve the issue as quick as possible.

For filing a mortgage suit the period is 12 years according to Act 62 of Limitation Act.

The Personal Remedy against the borrower is doubtful as the Limitation for personal liability is 3 years only.

The court notice has placed injection (injunction)…………….IT clearly states that that injection (injunction)…………….is placed!
Who are these ‘they’?
Is their charge right?

Wasteful multiple posts made by two fake experts without solution to your query, just to add scores to their credit. None of these two fake experts have provided you your desired solution on the best way to solve the issue as quick as possible. When you have already received a court notice, what is the relevance of suggesting you the limitation period of 12 years for mortgage suit or to ask, "who are these" they along with a very non-sense type of question "is their charge right"? Question arises, how you can judge at this stage whether their charge is wrong or right, if you have not mortgaged the property?

Now you would be able to notice their irritation through some more multiple posts on their part on their being exposed to you on their irrelevant posts.

Through the last post, Mr. Kumar Doab, a fake expert with unreal name has done nothing to expose his unsound mental state of health and irritation on pointing out of irrelevant and vague posts merely to earn scores to his credit.

What is the cause of action for the suit? What are the reliefs sought? Had you not verified the title to the property before executing the sale deed?
T. Kalaiselvan, Advocate (Expert) 11 May 2018
If you have received a court notice on this, then you ascertain the facts and see what best can be done in it.
The limitation for recovery of mortgage loan is 12 years hence you must ascertain if the recovery is within the stipulated time.
You can discuss with your advocate and proceed on his advise on all such further issues.
