sending Legal notice

Querist : Anonymous (Querist) 28 October 2010 This query is : Resolved
Respected lawyers,
can legal notice be send to the main addresse
without real signature of the advocate,I mean
instead of ink signature?does zerox copy solve the purpose?
sheeba (Expert) 28 October 2010
Legal notice can only be sent by a lawyer and that too original notice is to be sent with real signature.

But while producing it before the court, it can be only a photocopy since presumption runs saying that the original is with the other party.

it should be sent through Advocate after signature on that notice,
no xerox copies did not solve the purpose because it is secondary evidence you should file carbon copy of that notice when you file the case before the court.

do not think it to be any defect if at the time of trial the advocate sending such notice does not dispute its authenticity.

I agree with
sheeba.

Notice should be sent only with signature of advocate on it,xerox copy did not solve the purpose because it is secondary evidence, but xerox copy of notice may be produce in court for the presumption to say that original is with opponent.
